"Removing R.V. from his family will not further the interests of justice," Weinstein wrote, using the defendant's initials.
"It will cause serious harm to his young children by depriving them of a loving father and role model and will strip R.V. of the opportunity to heal through continued sustained treatment and the support of his close family."
How refreshing for the judge to say the man is a "loving father and role model." At a time when many people seem to feel registered sex offenders are barely human, that statement is almost revolutionary.

I have seen too many men sent to prison for simple possession of CP whose family suffered greatly, especially the children. A prison sentence for these types of crimes does not facilitate justice and serves no real purpose. Rather, it only adds to more pain and damage as the family is made to suffer along with the defendant. The breadwinner of the family is gone and the children have lost their daddy.
Sentencing the accused to a probationary period is fine, but taking him out of the community and away from his family is counterproductive to all involved.

My husband has done great in therapy, no matter how ridiculous it is and has not had an issue with probation for the 5 years he has been on it.
He has a VERY hard time finding employment. He has been lucky with the couple jobs he has had, but money is always tight, especially having to pay for therapy and probation every month.
Finding a place to live is hard. Again, we were lucky when we found the house we live in now. We've been looking to move, but now almost every landlord does background checks. Also, we can't afford much in the way of rent.
All of this because he looked at pictures. Because he looked at pictures we don't know how long we are going to be dealing with this, because of his lifetime probation sentence. It is so ridiculous the restraints put on us because of this. We have to ask for permission to do anything. Spontaneity is out the window.
His charge is not adjudicated, so even if he manages to get off probation it will always be there.
Its frustrating because I know he is not a threat to anyone.
Sanity? I don't understand. I can only hope that my life and the things involved hold the same weight, but this is a nice thing to see! Thank you for posting it!
Wonder what good ol' Paul has to say about the FBI distributing child porn.... let's ask him.... Oh Paul???
"Hmmm, ummm, well, that is a different story. When government victimizes children then it's okay. After all, they must have the tools needed to catch these molestors and so what if the FBI victimizes children."
And now we turn back to Ted for today's weather. . . .
I agree the the "Victim's Advocate" couldn't care less about the child porn victims except for the fact if judges continue to hand out sensible sentences for someone who is not a dangerous offender, she will lose her gravy train scheme of suing down-loaders of CP for restitution."
Let's hope this is sort of "enlightenment" in sentencing is where we are all heading: Maybe they could spread the justice if only to the sentencing of juvenile sex offenders?
Sentencing seems to depend not on reality or sensible guidelines for justice but often depends upon the degree of prejudice still residing in courts all across the country. About an actual (not a virtual) "recipient" of sexual abuse, it's worth reading: Missoula, Rape and the Justice Justice System in a College Town.by Jon Krakauer tells the story of an "old fashioned" "boys will be boys" judge, the sort of Judge and the sort of old fashioned :Justice" that understands noting and victimizes us all, no matter which "side" we stand on, extremes on all sides harm every one of us and protect nothing but the next election.
Does anyone imagine this sentence could have been handed down by any judge except a Federal Judge impervious to "election"?
This federal judge in Brooklyn, NY is obviously more progressive. The elected judges down here just rubber stamp what the prosecution or A.G. wants and it's a joke. We have judicial elections coming up, and I am refusing to vote for any of them because they're all the same. BTW: we have a judge down here that is now being investigated by our Judicial ethics board for inappropriate sexual contact with offenders. He's still on the bench, and not suspended and he won't step down.
