What state is this? That does not sound right to me - I would contact your local SO advocacy group and if you find a place to live and they will not approve it becasue of this I would ask to see the judge that is assigned to your case.

Many on here might remember that one time (while my son was still on probation - thank goodness he was becasue the probation helped with this fight) my son went for his 6 month re-register and they told him he had 24 hours to move from a place he had been living for 2 years. They claimed that the county was extended a Trail and that made his address ineligible(in our county the probation does not prohibit living near a Trail but the county ordinance considers Trails "liner parks' - right away we knew this info was incorrect and we started to fight - he got the sheriff office to wait a little citing that he could not possibly move within 24 hours. - they reluctantly agreed and my son wrote a letter to the judge on his case asking for an emergency hearing and even though it was informal (and she was not a very nice judge) she granted the hearing. My son printed copies of maps etc. and got an email from the guy who is the head of parks and recreation in the county (after writing him and asking) that there was no such plan in place. We did not know the answer until the day before the deadline they had given but we had a plan in place just in case. The head of the SO group of the sheriff office actually came to my sons house and explained that day that come to find out the person that had put into the compliance software about this proposed Trail had been to a county meeting where the had merely talked about this in the future and he decided it would be a good idea to just put the info in now to save time later. The email my son had from Parks and Recreation said that even if they did this Trail it would not be anywhere near where my son lives. The neighborhood is a very old neighborhood full of many poor people - not the kind of neighborhood for a jogging Trail.

So sometimes sticking up for yourself works! Do some research into the state, county, and city SO restrictions. Most laws and ordinances will list at the beginning the definitions of certain terms - for instance if it mentions Day Care in the law it should say what the definition of a day care is.

Wow 300 feet from playgrounds? That is not too bad! I wish we had that here - does playgrounds include Parks etc? I would get clarification on that day care definition - remember it could be just someone spouting off - in fact, how are they going to know when someone babysits if the place is not licensed?

According to the North Caroline statutes---110-86 (3), here is the definition of a child care facility---------------
Child care facility. - Includes child care centers, family child care homes, and any other child care arrangement not excluded by G.S. 110-86(2), that provides child care, regardless of the time of day, wherever operated, and whether or not operated for profit.

a. A child care center is an arrangement where, at any one time, there are three or more preschool-age children or nine or more school-age children receiving child care.

b. A family child care home is a child care arrangement located in a residence where, at any one time, more than two children, but less than nine children, receive child care.

Geezzz - how dumb this is - seems to me that the definition as originally written to stop people from conducting business as a daycare without a license - I did not see where it said what circumstances make it necessary to have a license.

All I know is if this is true then there is no hope for us to find a home when he is released. I feel like just giving up hope. Thanks uou guys

Baby, if you live out of the city limits, it can be a good thing. My guy and I are going to be living with a family member at the end of a street on a hilltop near a small town outside a larger city, and as far as I know, that's going to a safe place for us. Don't quit looking!

Mr. Sheriff did not give you the full explanation of the statute.

That statute makes an exception for certain baby sitting situations. I know, I just read the entire statute and all its amendments.
