you would have to have your lawyer write the letter cause its not going to be up to the judge its the DA from what i was told by my probation officer that i need lawyer to write the letter and then my probation officer . said "that he wouldn't say i should get off but since i have not gotten in to trouble or failed a drug test or violated in any way but i wish you luck

Pursuant to Title 18 U.S.C. 3564(c) and 3583(e)(1), the Court, after consideration of certain factors, can terminate a term of probation in misdemeanor cases at any time. In Felony cases, the court, after consideration of certain factors, and after the expiration of one year of supervision, can terminate the term of probation or supervised release, if such action is warranted by the conduct of an offender and is in the interest of justice.

As you can see, after one year of supervision, the probation can be terminated by an order from the court; however, if the offense involved is a sex offense, the chances of early termination are greatly reduced.

Judges are extremely cautious when terminating probation of a sex offender, but it is possible.

Good morning Love, I too am on federal probation, almost half way through my 5 years. I've done everything I can to stay off the radar, have gone to almost all our group meetings and no issues with the poly.

I talked to my lawyer at the 2 year mark (about 6 months ago) and she spoke to the government side to feel them out, and since I did not receive any jail time they were going to be against it until I at least finished therapy. Therapist says I could be done in 6 more months give or take, so i'm trying to be as patient as possible! It's good knowing that an end is in sight.

Did you have to hire a new lawyer or spoke to the one you have before prior being sentenced & everything? Because I had a public defender

If you read further in 3583(k) it says "(k) Notwithstanding subsection (b), the authorized term of supervised release for any offense under section 1201 involving a minor victim, and for any offense under section 1591, 1594(c), 2241, 2242, 2243, 2244, 2245, 2250, 2251, 2251A, 2252, 2252A, 2260, 2421, 2422, 2423, or 2425, is any term of years not less than 5, or life."

I still use my FPD that I have had from the beginning. She is awesome and seems to be completely different from most stories of FPDs i have read about. She plans to file the day after i am released from therpy.

Cats, the judge has to consider everything. If he can give someone probation and not prison if he wants, he can also end it too. It has happened, not often but it has.

My son has just finished his 2nd of 15 years probation. We have a lawyer and will soon be petitioning the court to have his probation cut back. I want to push to have it end.. we'll see what happens.
