is cp considered a violent crime?

My son asked me to look up what i could find on the reducing the serving time from 85% to 65%. all i read was that it was considered for non violent crimes. I told him i thought possesion of CP was considered that. he said why? so here i am asking you all. Is it? and what do you know about the reduction of time? thanks

For sentencing purposes and as far as the DOCs are concerned, yes, it is a violent crime. I think it is also considered a violent crime in federal, but if I am wrong someone can correct me. It is also considered a violent crime for the purpose of good time credits in the state systems.

There has been talk of reducing the time to serve in the federal system from 85% to 65%, but I think it is wishful thinking more than anything else. There has been no real effort on the part of the Congress to make any reduction.

Some states have the "truth in sentencing" which requires the 85% rule, but I have not heard any other states that have decided to drop the percentage from 85% to anything lower.

It is my understanding that if the images involve those under the age of 12, it is considered a violent offense, therefore the offender is a violent offender, go figure, someone who has never so much as laid a hand on anyone can be violent.

I know that my son in FL it was considered a violent crime and the images he has were post pubescent females -

In Oklahoma, the DOC considered any sex crime except indecent exposure a violent crime, even consensual sex between an adult and an underage person. I imagine other states' DOCs have the same policy.

The classification is important as far as the DOC is concerned as many of the programs that inmates can take are unavailable to those with a violent crime.

Before around 1997, the good time credits also depended on the nature of the crime. Before they passed the "Truth in Sentencing" in the late 1990's. Non violent offenders received an extra 30 days good time credits, which violent offenders did not.

Seems like it depends on the state. When my son was in the county jail, he was placed with the non violent offenders. He did all his time in county; he never went to a prison.

My LO is serving a Federal sentence for possession of CP. He was home on a bracelet for 6 months with no problems but when he went to his plea hearing the judge's clerk emailed his attorney before we even got to the courthouse saying he would be remanded to custody as his was a "violent" offense.
