I have two adult sons in prison for sex offenses. One is in Iowa and the other is in Colorado. Both have very long sentences. I live in Missouri, but would love to move to Colorado, as soon as I can sell my house. I don't really want to move to Iowa. I would like to have both my sons in the same state, so I don't have to drive two days to be able to visit them.

My questions are these:

1. Will states do interstate transfers for those still in prison with long sentences?
2. Will the receiving state honor the sentence given by the courts in the sending state? Or, would the receiving state reconstruct a sentence based on their own laws?

The interstate compact aggrements differ slightly from state to state, but I believe the receiving state has 45 days to answer the application from the forwarding state. I am not sure, but no, the length of the sentences are not important. The only thing that matters is the the sending state decides to sent him and the receiving state decides to accept him.

No, the sentences will not change. Either of your sons will be doing the same amount of time with the same sentences as they are doing now, but it will just be in a different state.

i put in for a intrastate compact. i had an apartment lined up free of charge, but no job and no relatives around the area. i was denied. :( you do have to get the state and county that they want to move to to accept them. luckily enough they'll have a family member (you), and a place to stay (so the state doesn't have to pay for half-way housing). so there might be a good chance one of the sons will be able to move to you. good luck.
