There have been a few cases that I remember that is similar to the situation you described.

In every case that I have seen, the court ruled that the SO could not be forced to move from a house or land that he owns even if a park is built after the house is purchased.

I have not seen one case in which the homeowner was forced to moved.

So, the answer would be "no".

Most people are grandfathered in anyway, but the key word here is "own" the property. They will not make you sell or vacate your own property if a park or whatever is built after you bought said property.

One thing you could do is check out the planing for the area you want to live in just to be on the safe side of things.

In Florida that is the law at this point and of course they are supposed t to apply the laws that exist at the time. I know that your name has to be on the deed of the house. Good luck to you!

Here in Illinois the law allows you to stay only if you owned the house before sex offender laws were put into place. I would research the laws for whatever state you are in online before you buy a house. My husband and I plan to buy outside of town if/when we can rather than buy in town and years down the road when someone starts a state licensed day care be forced out.

yeah Florida allows you to stay in the house if you owned it before the laws if when you are convicted the house is not eligible - however, if you buy a house after you are convicted that is an eligible house and then after you buy it a school, daycare, or Park etc. is built you can stay in the house.

we have owned our property for over 20 years and during pretrial the judge required my husband to move in with his mother (who lived in a trailer park filled with kids) - after 18 months of waiting for an indictment ...the court then believe that they had a duty to protect the public ... because we live within 300 feet of a park ... the PO came over and did a visit - my husband was given the "ok" to return home.

As I said early, the key word here is "own." No court in the land will allow anyone to force you to move off property you already own if a school or daycare center is built nearby.

It is possible that some sheriff or town ordinance might pass a law that tries to force someone off their own property, but trust me, it will never hold up in court.

In my situation a couple who lived across the street from me started a day care 3 years before I moved in. However, it was not state registered so when they registered it the husband (who knew of my SO status) had the sheriff come out because he felt my presence was scaring off his business. There was an investigation and the law turned out to be on my side. We don't talk anymore but at least I get to keep my home regardless of their feelings.
