It should all be set out for his release. My husband had conditions on bail which will be the same on his release. No unsupervised contact with children under 16 unless parental consent is given or in unavoidable circumstances during day to day activities. We were able to work it so as long as I was there it was ok but a protection order was put in place so he wouldn't be able to be here during my sleeping hours. It was horribly stressful but worth it.

OK so me has 10 years probation and is a registered offender. I believe that probation says no minor children. Is this the same thing? That's what's confusing me..some people have contact with kids while others cannot.

It really depends on your brothers crime, and his PO when he is out of prison. Chances are he will have to work towards having contact with your son. But there is really no way to know at this point.

You can go talk to your local PO office and explain your situation and ask if they have a chaperone program you could take classes for.

Your brother needs to just take care of business on his end. Get in therapy if he can in prison, and try and learn a skill in prison that he can use to get a decent job outside.

For me, my PO said no to a lot of stuff until I finished therapy. Once I completed that, and had a job and passed poly's, probation was much easier and the PO wasn't such an ahole to me. I was able to go hang out with minor children in my family as long as all the parents signed off on knowing about my crime.

And they were there to supervise at all times

My son was on probation in FL - I am not sure if the predator designation changes this or not but he had to go to treatment - take polys etc. and have an assessment - once those things were done he had to get a "plan" from the counselor and a paper signed by all the families (this was just for family minors) and then a judge had the final say as far as yes or no. My son's judge was a bitch and said no (for no good reason - she said she didn't need one) - but from what I understand judges usually always approve it because it is part of the treatment. The counselor said he had never had a judge deny one. As a side not that judge has recently been removed from criminal court. So he had to wait until probation was ended until he could interact in any way with a person under the age of 18.

I will not tell you it was easy - it wasn't - my daughter gave birth to her first child 2 years into it and my son was not allowed to meet his nephew until he was 2 years old. Once probation was over he was free to not worry about that but (except for family) he still does - he is on guard around children all the time - not because he is afraid he will do something but because it is too easy for him to become a target. What area of FL are you in? BTW do not post any specific personal info because it is not secure. I live in central FL. Advocate2 I am in south FL....the worst place to be. OK, so there is hope for us I see. We have a huge family...but only 3 children will be minors and their parents are more than willing to sign off.
What is FAC? I am not familiar with this.
And yes, I gave birth to my baby 3 years ago, while my brother is in prison and he will be 8 when my brother is released...and then they still cannot meet until we get permission. I am so upset by this.

I know - it is heartbreaking to say the least. Holidays were the worst - all the family around a huge hole in my heart. I was so joyful this past year on all the holidays because my son could finally be there. It will be hard - there is no way around that - but your brother already has one of the best things he needs to get through this and that is your obvious love for him.

BTW - are you sure about the predator designation? I might be wrong but I thought that is determined once they are out and then register?

Wow that is weird - that would mean that information about the registry is on his adjudication? Has anyone else experienced that? was it part of the plea? even that seems unusual to me

It was part of his deal and due to his charges. He will be a registered predator. It's an entire mess I tell you.
