Sex offenders can not be subjected to punishments under newly created laws if they committed their offense and served their time before the legislation was passed, the state Supreme Court ruled in a 4-3 decision Monday.
“A well established principle of ancient origin is that the Legislature cannot increase the punishment for a crime after it has been committed,” wrote Justice Barry Albin.
The dissenting appellate court judge said that a monitoring devise was regulatory and non-punitive. The Supreme Court ruled Monday that it was a punishment and therefore couldn’t be imposed retroactively.
Good news. I hope more and more states realize that the registry is becoming punitive and we have more court victories.
Too all my fellow posters-----regardless of how bad your situation is, there is always HOPE, and frankly, with more people----and judges-----understanding that some of these laws are punitive, there is a lot of HOPE.
You never know when someone will bring a case which will benefit you, your family, and your loved one. Yes, they may have a lot of restrictions now, but you just never know. Someday----and it happening more and more----the courts may rule that some of those ridiculous restrictions are becoming punitive and your burden will be lifted.
This court ruling only affects those in New Jersey, but you never know, someday it might be YOUR state.
The only people who are losers are that that give up entirely.
We have to keep the faith and STAY UNITED.

During my degree in Criminal Justice, I remember then my professors used to said: " that the laws were to punish the criminal act and not the person who committed". Of course that's BS.

damn i have hopes. hopes that may come true by the time 10yrs have passed!!!!
I also need to clarify that in no way do I think that "our" plight is the same as what segregation was - those folks were not criminals. The only correlation I use is that sometimes the Supreme Court does not see the truth.
so again, "separation is not equal" or fair. and in so many, many instances we know it makes the problems that the registry much worse. such as successfully reentering society, housing, working, schooling and keeping a family together.
I'd love a state to rule the act of registering in this day and age of apps that blast your info to everyone with a phone is punitive and apply ex post facto to them. Same with the restrictions. Punitive.
But this is a start.
