A California statute requiring some sex offenders to report to police in person every 90 days for the rest of their lives does not violate the constitutional right to be free from personal restraint, the Ninth U.S. Circuit Court of Appeals ruled yesterday.

Before anyone gets too depressed, just remember that this law only affects the most violent predators, not the run-of-the-mill registrant. My gosh, look at this guy's history.

I wonder if the registry is actually ever declared punitive by the US supreme court if it would change that ? You know looking at that list you posted REW on the other thread - I never released that Washington DC has some of the most relaxed SO laws of all - very short registration requirements - no living restrictions or job restrictions - according to their tier system my son would only be required to register for 10 years - he is almost half way there already

Well, in CA it maybe only the most violent but in some states like PA, it's all tier 3's and rmember my husband and plenty like him were lvl 1 low risk before AWA as adopted. So hopefully that ruling inCA doesn't set a trend in other states if there are chalenges

Okay scratch that..after reading it, it's only SVP I guess that register every 90 days there. However, in many states with tiers, tier3's do as well. And it's life time.

In Oklahoma a tier 3 registrant must register every 90 days for the rest of his life. I think this is the situation in a lot of states.

The tier system in Oklahoma---and in many states----is based on the offense committed only and no other factors are taken into consideration. As a result, the great majority----probably close to 80%---of the registrants were reclassified as tier 3 because of the 2007 law which created tier levels.

I dont understand what happen in California, some sex offenders have to report every 90 days How do you know if your that lucky one?

I have an indecent assault, corruption of a minor, and indecent exposure. All misdemeanor convictions stemming from the one case. I was a tier 1 with 10 year registry until Adam Walsh act went into effect, then I became a tier 3 with lifetime registry.

I think all the AWA states make the tier 3's register every 90 days for life.
