Oh My God!!! It's the nightmare that keeps on giving!! H land has finished their investigation. My husband was indicted Thursday night. I guess, now the "fun" will really start. They are charging my husband with... Two counts of unintentional visuals with two counts (for the unintended visuals) of intent to view. What the Heck does that mean??? When I asked our lawyer what the feds were even talking about, he said, they are basically charging him for a pop up virus. WHAT!!!!!! When my lawyer heard it was only two counts (and No Search, No Creation, No Sending, or Actually Being Sent) he assumed they were just going to hand it over to the state to handle.. They said "No, we are going to hold onto this one". WHY!!! My husband and I are absolutely NOBODY!!!! My lawyer said he has had thousands of cases where there are thousands of downloaded images and the feds just hand it over to the state because they tell him the cases are just too small to be bothered with.. The want to destroy my husband for a pop up virus!! WHY??? I feel physically ill right now!! He has to go on Tuesday morning and be officially charged. They are not going to arrest him. They said he can remain free as long as he does not leave the state. If they think he is such a danger, WHY are they STILL going to let him walk free???? God, I can't even breath!!!

Nobody said I don't belong here. I just noticed a lot of people are asking that they not be judged before they start to tell their stories. I just wanted everyone to know, I'm not judging or throwing stones. I have done so much research on h land and if there is something I have learned that someone here might be able to use, I am will to help as best as I can. All of you have been so kind and supportive here to each other. I can't tell you what a comfort this is to me. This whole investigation has been the most horrific thing I have ever had to deal with (and I have been held at gun point twice and I saw a man attacked with a butcher knife and stabbed three times in the back!). I am grateful to all of you. Just know that someone understands what is happening is a comfort. I am dreading Tuesday when my husband goes to the h land office and is formally charged and finger printed. :(

I do have a question about who can see this forum... If someone were to type a search for specific wording.. Some of our comments show up in the search. Is there a way to turn that of? I thought the only people who could read this group conversations were people in the group. Just a little nervous I guess. This kind of case will do that I guess. UGH! I feel like an idiot! :(

No it is not a private forum - sometimes certain phrases will turn up in a Google search. If you need anything deleted ask an admin to do it for you. Also make sure your member name is not one that you use elsewhere so no one can recognize you ... the admins will be happy to help you

I'm sorry about the confusion about who belongs here... Please believe me, nobody has said anything derogatory.. I was recently in an online support group for spinal damage and had been told I didn't really belong there because I didn't get my condition as a result of a failed surgery. Even though the ending result was the same problems they were all dealing with. I felt like an outcast. We all have the same problems here. It doesn't matter how we got here. I'm grateful to all of you. God at least pointed me to a group that has treated me better than the spinal group people did. <3 Funny for a bunch of disabled people, they sure could kick some butt with a keyboard. :(

I'm glad to hear that no one said that you didn't belong.

People say they don't want to be judged, because anywhere else they go, people do judge them for what they or their loved one (LO) has done. We have people who come from many backgrounds, experiences, charges, etc. Some who are a LO, some who are offender, some who are guilty, some who are innocent, we even have former victims who have joined. If someone joins and isn't here for support or give support they are removed.

One part of me is grateful that this site is public, I wouldn't have ever known about It otherwise. On the other hand, I also sometimes wish it was private, but in those cases, I do PM's to talk more privately with a trusted member. I am also careful not to share too much that will identify who I am. I've already had attacks against me on other sites because of who my LO is.

I wish you guys luck on Tuesday. You got some good advise from the others here. Trust your lawyer to sort out all the legal stuff and maintain your innocence. Don't let law enforcement bully you into anything.

He finally got home around 6:30 last night. He was just a mess. The judge he had yesterday will not be our judge for our trial (if it comes to that... Our lawyer is hoping to have the whole thing thrown out.. Which would be great. But from what I have learned from all of you... I won't hold my breath :( ). She was a bit of a witch. She want to lock my husband up, but my lawyer had to keep telling her he had already set his release up with our federal judge. After she finally let him go she started emailing our lawyer and giving him a hard time because we have long guns and air pistols. These guns don't even have to be registered. Two of them are just BB guns! Thank God we don't have to deal with her again. My sister in law came last night and took the gun cabinet and all we have to her home. With how this judge was acting I am surprised she didn't insist on taking our Bows away too. UGH!!! He is out at least and safe with me. Now, our lawyers get to go through everything and have their forensic teams go over our things. H land needs to be destroyed and shut down. They are nothing but Nazis. :(

Convicted felons cannot ownfire arms. The judge seems to have overlooked that 'convicted' is the operative word. Shelly, we all hope your husband will not be "convicted" since this judge and the H Land 'investigators are in a rush to prove their prejudice against 'sex offenders' is right. I hope your lawyer does get this thrown out of court.Good luck and, as frog pond1 says, keep us posted.

air rifles and any thing co2 power are not technically fire arms, there is no fire to project the projectile

Sorry your going through this and yes it is a complete nightmare. I went through pretty much the same thing with my husband three years ago. H Land took everything and in the end only found like 24files that were actually considered CP. It doesn't matter of intent....feds have a flag, virus or whatever you want to call it on CP files that are currently being investigated and unfortunately if they get downloaded then regardless they are knocking your door down and won't turn it over to state no matter how many or little files there are. Feds are insane when it comes to CP cases.

gizmochloe13 that's the odd thing... The things they found weren't in a search, weren't downloaded, weren't created, weren't received, or weren't sent. It's just so confusing. How can someone have intent to view an unintentional visual? It's like saying I didn't mean to fall but I meant to break my leg. It's like a contradiction of itself. :(
