All the time! You can get convicted on word alone. However, it may in your son's favor if the DNA test rules him out. Some has had their convictions overturned due to DNA evidence.

I hope that is not the case here.

I cannot ever remember reading about a case in which the prosecutor secured a rape conviction if the DNA excluded the suspect. Most prosecutors will drop the charges if the DNA does not match.

My guy took the plea deal that was offered to him, even though he hadn't done the crime, because his attorney told him that they had "irrefutable" evidence. My guy was confused because there's no way there could be any evidence, but the prosecution was tough and the defense didn't care.

my son took the plea because the judge said he was not going to win and that he was risking 25 to life.The evidence was circumstantial and hearsay from a vindictive wife who wanted full custody of the children, Prior to the accusation she did not qualify to have custody due to her backgrouund. A real mess and nobody cares. the actual person who is guilty still walks free.We felt sure justice would prevail. WHAT A CROCK! For some there is no justice.So sad=my son's life is ruined, my grandchildren's lives will be forever affected and as a mom I grieve everyday.
