The meeting probably will be relatively short and your BF will not be directly involved. There will be no witnesses or testimony involved.

Were there any marks or bruises on this young lady?? Is she willing to testify?? I don’t know the details of the case, but I would think any defense attorney should be able to get a better offer. Thirty-five years is ridiculous for consensual sex with a 16 year old by a first time offender.

But if he goes to trial the DA will try him on both counts. If this is a simple consensual crime between two people in a relationship, with no violence, or any extenuating circumstances, then a lot of juries would hesitate to give him 35 years. But, of course, he is in Texas, so I am not sure.
I think there must be more to this case than you know for the prosecutor to be playing so hardball.
If a DA did not have a good case and did not really want to go to trial, he would be offering a sweetheart of a deal---something like probation or five years in prison----in an attempt to entice your guy to plea. In that case he does not want to go to trial as he thinks he does not have a really strong case, so he hope to get a conviction with a plea.
