ACTION ALERT: The Barber Amendment also applies to non-violent sex offenders

6-14-2014 Washington DC:

Just in case folks do not realize this, H.R.62 Federal Prison Bureau Nonviolent Offender Relief Act of 2013, or better known as the Barber Amendment (click for back story on Barber) is awaiting passage in Congress, and it also applies to non violent sex offenders.

This would be an excellent start to help those with non-violent crimes.

But, in most states, many sex crimes are considered violent crimes, even if no violence occurred. Of course, rape is violent, but so was statutory rape. Also a young man having consensual sex with an underage female in a relationship was considered violent. Also if a guy puts his hand on an underage female's breast and did nothing but touching or patted her on the butt, that was considered violent. Child molestation was also a violent crime. At least this is how it was in Oklahoma. I know that for a fact.

These classifications were set not by statute, but by the Department of Corrections. I don't know how this new law would handle these aforementioned cases.

But even if the new law only pertained to child pornography cases or solicitation cases over the Internet, that would be a great benefit.

I also see that this law would pertain only to federal inmates, so I don't know how they would handle that.

Since crimes such as rape, molestation, etc. are handled on a state level, any state classification of the crime as violent or non-violent would not matter.

But it would certainly help with all the child pornography cases that are prosecuted on a federal level.

Classifying a crime when an older male, for example 20, has sex with a younger underage female, say 16 years of age, in a consensual relationship as a violent crime never made sense to me at all, but that is what they did in Oklahoma. Because it was considered a violent crime the amount of good time credits were reduced from 74 days per month to 44 days per month.

@johnson23, I never knew anyone who had a child porn conviction when I was in as that was years ago, but I wondered if they would classify it as a violent crime. Thanks.

It may depend on the jurisdiction whether cp is considered violent or not. When my son was locked up in county for cp, he was placed with non violent offenders.
