Sometimes justice is tempered by mercy. While I still truly believe (as did my expert psychologist) that probation only was warranted, my client is rather lucky and I am thankful that our judge sentenced him to only 18 months imprisonment (he will only have to serve a little over 15 months since Virginia allows for 15% off for good behavior). This was a departure downward from the 26 months called for by the Virginia sentencing guidelines. In that regard, my client also is lucky that this did not go federal. If it had, he would have been looking at upwards of 8 years or more. The result just reinforces for me how important it is that in ANY sex offender case to either hire an expert to evaluate the defendant or move the court to appoint one. Failure to do so, in my opinion, is malpractice.

Keep in mind that many, if not most, sex offender cases are litigated by a public defender who does not care about things like the cannon of ethics and due diligence.
In my wards case, he had a public defender who admitted she is a victim advocate for women who have been raped and subjected to domestic violence. She deliberately destroyed evidence exonerating my ward; would only advocate for my ward to go to prison, and told my ward what to tell the Judge so he would be found guilty.
The judge who sentenced him to prison is the same Judge who just a week before signed court papers declaring my ward totally incapacitated and totally disabled without exception and appointed me to be his guardian in full guardianship.
Ya . . . so much for justice because in today's reality nobody gives a crap about things like ethics, conflicts of interest and malpractice.
Where is the compassion for the millions of families----including those with children----that recently had their monthly allotment of food stamps cut?
Where is the compassion for the thousands of brave young men and women who served their country admirably in Iraq and Afghanistan and came home with serious injuries yet cannot get adequate treatment for those injuries?
Where is the compassion for the thousands upon thousands of innocent Iraqi citizens who were slaughtered or made homeless when we decided to start a war on false pretenses?
Where is the compassion for the innocent children who are maimed each year from our drone aircraft?
Where is the compassion when a bunch of armed hoodlums posing as the FBI or ICE goes into a home at dawn, treats the residents like the enemy and shoots their dog?
So why should we show compassion for someone with child porn?
I could go on and on.
There's very little compassion left in this country.
Only greed and a lust for power.
