There are no laws in Ohio which would preclude a sex offender NOT on probation from being around minors. If he is NOT on probation or parole---often referred to as “paper time”--- and thus has completed his court mandated sentence, then he is only on the sex offender registry. If he is only on the registry, then legally nobody can tell him he cannot be around minors.
If he is on probation or any type of paper time, then I doubt his PO will allow him to be around minors. Ohio does have residency restrictions, but that applies to schools, daycare centers, etc. Your grandson can be around your son in law at your house without any problems with the law.
Now, while he is legally OK with being around your grandson as far as the law is concerned, anyone can file a complaint with CPS that a sex offender is around a minor. I doubt it would go very far since he is only around the minor and not living under the same roof. Also, he will not be alone with the minor, as you will probably be there. But even if he were alone, the law cannot touch him.
As far as your DIL, again there is no legal reason her son cannot be in the presence of your son in law. But if someone complains, the CPS could ask you some questions. The mother is certainly on safe ground legally, but CPS could open an investigation. But I doubt they would and I personally do not think the DIL has anything to worry about.
I only mention CPS to cover all my bases. There would have to be a complaint filed and I doubt CPS would pay much attention to the complaint anyway.
When I was released from prison, my son moved in with me. He had minors over all the time, and my grandson came over several times a week. I was on legally OK, and nobody filed a complaint with CPS. I was only on the registry and had no probation or parole time to serve. I never worried about CPS at all.
You said, “My crazy daughter in law says my 13 years old grandson can not come over or she will be put in jail for letting him around my son in law.”
That is not correct. I don’t know who would put her in jail since it is not against the law for him to be around your grandson. The police certainly would never place her under arrest as no law has been broken.
She sounds as if she has been listening to too many people who are uninformed about the law.
BTW, I hope you are doing well and that Mindy is getting along fine. I miss visiting with you from time to time.
