My daughter has sentences in 2 counties. the terms are running at the same time. She filed judicial release in the county with the shortest term and was denied. But now has a hearing set for the longest sentence. whoo hoo. I think that means that she will probably get that release but will still be in prison for the other county. She does not have a lawyer so I am not sure how all this will work. Lots of if this then this. Lots of speculation on what will and can happen. Anyone know how all this works with 2 different counties and two different sentences?
Mine had to spend time in MN, because of his arrest there. Then he came to our county, until the court dates here. He stayed in MN around a month or two, then got taken to WI, where he was about 6 months before being taken to the prison. Could be different where you are. But in our county jails, if you get 1 year and 1 day, or under that, you stay in county. Anything over the 1 year and 1 day, you go to prison.
Let me try to help you out as I think you are somewhat confused.
An offender or inmate can only serve one sentence at a time. You daughter is serving one sentence, which consists of two counts from different counties. Those two counts from different counties have been run together---concurrently---into the one sentence she is now serving.
If she has been denied judicial release on her sentence, I don't know how they are applying for another judicial release on the same sentence. Even though there were two charges with two counties involved, the court system sees that as one sentence.
Since the two charges were run together into one sentence---concurrently---she is just serving one sentence, not two sentences.

That does not make a lot of sense and is not consistent with two charges being run concurrently into one sentence.
Are you sure the sentences are run concurrently and not consecutively?? If I remember correctly, when we talked months ago, your daughter plea bargained----and plea bargains consists almost always of charges running concurrently.

You said the she has a hearing date for the longest sentence, after being denied for the shorter sentence. Has she actually received word back from the court regarding the hearing date or has she just petitioned the court for a hearing?
