The procedure which allowed the DOC to increase the good day credits which enabled an early release for inmates was no doubt enacted through state statutes; in fact, I know it was as I have the statutes right here in from of me. Therefore, the legislature would have to repeal the old bill or modify it in some way to stop the extra good day credits being issued.
If the legislature does that, it may not affect your guy since he was convicted before any pending legislation. I don't know that they would make the new law taking away credits retroactive, so he would probably be grandfathered in. If they did try to do this and make it retroactive, you can bet there would be lawsuits filed by the inmates and their families.
I cannot tell you with complete assurance that I don't think any new law would affect your guy, but I can tell you almost positively that they cannot take any credits they have already given him.
Would the legislature attempt to repeal the extra good time credit law? Who knows? In politics anything can happen, but it may not even affect your guy.
