My 20 year old son in Indiana got his plea agreement in the mail today. He's going to prison on a 3yr do 18month sentence- then 90 actual days on top in county...for a D felony. He's guilty of possessing marijuana. My heart is broken. We own the bail bonds company in a small town and I really feel this is the powers at be way of punishing us through him.
It has fractured our family. He's still in County Jail right now. I'm still in shock that all of this is real. In 18 states, with his panic disorder he could be prescribed marijuana- but not in Indiana. I know he broke the law, but it seems harsh. I don't know if I can do this, which seems selfish, since he's doing the time behind bars. Somehow I will do this, but I can't imagine a good day, a day I won't cry for the next couple years. I can't imagine how to breathe without worrying for his safety. I can't imagine the fear he has..

Tell him no snitching, no getting in debt, and to mind his own business. Find a couple of decent friends and hang with them.
He will be OK, mom. With that short a time he will be in a minimum or some type of work release. The inmates there are really layed back because they are at the tail end of their sentence. The last thing they want to do is cause anyone problems and mess up their going home date.
He will be fine.

For you take it a day at a time its like grieving for someone who has passed away take it a min at a time keep talking or writing to him letters are really important to them in there.
Come on hear talk to us whenever you feel like it we don't judge. It is a lot to get your head around.
We all have good and bad days iam into year number 3 of my man's 4 years and I still have bad days! What your feeling is normal hang in there.
My son went in too. He did ok. He knew this had to be a deal breaker. Once in prison they get time to think that what they were doing just isn't worth it.
I agree with you that since 18 states say its legal, then it's stupid they are wasting so much money punishing people for doing it. Just a pure waste of time. Gotta be a ulterior motive in their heads why its still a terrible thing. In my years of experience with a son and fiance always in prison, one at a time, or sometimes both at the same time, the prison system is a joke. The courts make money off of fines, the state prisons get paid a good hunk of money per day for each inmate from the federal government. Our lives are destroyed for them to profit.
I know a joint is breaking the law- but their breaking my heart...I would think that would count for something.
We own the bail bonds company and I see so many get amazing deals for meth, but no deals on marijuana. I'm so very glad I found this group. I really will need it. In my small Indiana town, there is no one that will speak to me right now over what's happening. I've lost a lot of people in my life.

If he is in medium security, those are pretty tame for the most part, at least where my two have been.
The shocking part of all of these stories from you and others is that there are truly guilty people and if they have the right attorney, who knows the DA, knows the judge, they get off, but innocent people get nailed with all kinds of bogus things. Mine has been in prison for 3 years, with 3 months to go for having one beer, and getting breathalyzed within 5 minutes of drinking it, which means the alcohol content is higher. It was .04... then at the jail an hour later it was 0
I think you definitely have made enemies in the courts with your business for some reason, and that's what's happening. Never will prove it though. The court system, and corrections are the most corrupt agencies there are.
Someone is giving you some really bad information and advice.

The fact that the robbery charge has been dismissed has absolutely nothing to do with this at ALL. That charge is dismissed and gone forever. So there will be nothing mentioned about any robbery at his sentencing. If the robbery charge has been dismissed, then of course, it would never be any factor in the security level your son will be sent to. And, BTW, age has nothing to do with the security level an inmate is assigned.
I dont know who theyre is when you say theyre telling me he will be in medium to maximum, but they do not know what they are talking about. First of all, the only people who know the level of security your son will be at is the Department of Corrections in Indiana----not the judge, not your lawyer, and certainly not the DA. The judge and DA can make all the recommendations they want, but the Indiana DOC has a classification system that they will use to make the security level determination. The DOC is the only one who will make that determination. They will do that through a classification system which will take in consideration the crime, your sons criminal history, and the length of the sentence.
Secondly, they are not going to place your son in a medium, let alone a maximum, for a single count of possession of marijuana. That is ridiculous and no state will house someone in a medium security prison with a charge like that.
He had a three year sentence for a non-violent drug crime and he is a first time offender-------no way would they every put him in a medium.
The prosecutor only threw that robbery charge in as a red herring to make you think he was doing you a favor by only prosecuting the single drug charge. He was hoping that dropping the robbery charge would sweeten the deal and make your son jump to take the plea.
I agree with your sons attorney that they have him on the possession charge. There is no way he can beat that. I wont even mention the robbery charge because it is so ridiculous and frankly, the DA is just playing games. He knows damn well he does not have the evidence to convict on robbery.
This is a common game the prosecution plays----overcharge the defendant, then be willing to come down to the level he should have been charged with in the first place.
Hon, dont let your heart be broken. He WILL be OK, and so will you. I was at a medium for 8 years. Your son will be fine. Nothing happens at a minimum because everyone is on their best behavior----they want to go home. I noticed on the Indiana DOC site that your son will get some good time credit for good behavior. Trust me, he will not serve the full three years. It appears he will get at least three months reduced from his sentence for every year he serves and he can get more good time credits by attending some of the prison programs. He may well be out in less than two years---if he is in that long.
