Idaho usually flops the guy, doubles the time served and finds any way to violate.
The sentence handed down at sentencing is etched in stone and can only be changed by a judge or an appellate court, and even then it is almost never enhanced. An appellate court can overturn a conviction or modify a sentence to a more lenient one, but a sentence is almost never enhanced.
What does this mean? If an offender is sentenced to “x” number or years by the sentencing judge, the DOC or BOP cannot change it. The BOP or the DOC can change the amount of good time credits given to an inmate, as that is an administrative decision.
There is a document called the Judgment and Sentencing document which spells out the exact nature of the sentence for each offender. This document is signed by a judge and is often referred to as “sentencing papers” or a “J&S.” The document can be obtained by contacting the Court Clerk in the country from which the offender was sentenced.
Scaredkitty, I am not sure what you mean by Idaho “doubling the time served” but Idaho cannot change an offender’s sentence once it is handed down by a judge.
