I am on disability and at the end of January I notified both my mortgage company that I would be leaving my home and they could have it back.
It is now June and it is still not auctioned off. I got worried and called my local Legal Aid office and spoke to an attorney.
Turns out if you are disabled and on SSDI you are considered "collection proof" meaning they cannot garnish your income.
Now there is another circumstance that they could garnish but there is a way out.
If you find out that a creditor is seeking to garnish you for, say medical bills, all you have to do is call Social Security and have your checks sent directly to you.
From what I understand if you have direct deposit and they get a judgement against you (credit card, car payments, doctors) they can garnish your checking account if they get awarded.
I hope this takes a load off of someones mind-it did me!

Thank you. Any other info on this would be helpful. It would be nice if we had a group trying to get out SSI for our disablities. Its been almost 3 years I have been living like this. It sucks. I just want what I paid in. Nothing more. I am truly disabled and need it.

I somehow got my SSI 1st try-not braggin here but think it was cuz I asked my angels to go with my envelope and be there when it was look at! i think they were present and whispering in the reviewers ear...try it next time-cant hurt

That exact thing happened to me...the garnishment, then I withdrew at night and got the money back before the bank opened in the am. Then I called ss to have my checks sent, which I am still doing. It's a good deal, they mail early and I can cash early! Hope this helps someone out there!
