summer visitation need help!!!

me and my x have vistation set up and all layed out extremly clear in our order he is to have 7 weeks through the summer with her because he lives so far away and it is to be uped to 8 weeks when we both agree its in our daughters best interest she is only 6 and i dont think that 8 weeks is a good idea i have told him flat out that i am not in agreement to 8 weeks and he is insisting that he is taking 8 weeks wether i like it or not. him and his wife are also having a baby at the begining of september and want to also keep my daughter out there till the baby is born then a few more days before she comes home. where we live school starts the end of august so there is a good chance she would be missing almost a whole month of school if she ends up being over due. i dont know what to do i cant afford my lawyer anymore is there anything else i can do i have a fully enforceable agreement across canada so should i let him take her for the 8 weeks and after 7 phone the cops? im so stressed out and i need advice please can someone help me??/

Is this 8 weeks written in a court doc? If so, you may be out of luck. I understand the school thing. If its that big of deal, is it possible that she leaves a week earlier and gets back to school sooner. You may want to contact your local mediator as they are usually more versed in laws of this nature. I know this from experience. Lawyers go to school and what not, but so do paralegals. They also specialize in these matters and tend to know the laws of the state of jurisdiction better. Plus, their about a 10th of what a lawyer costs. 20 an hour vs. 200. Good luck! Bye the way, some states do hold parents responsible for truancy issues if they miss school. E.G. Texas. A fairly large fine and several days in jail in some circumstances.

Why in the world would they want a 6 year old around when their baby will be born? Who's going to take care of her while stepmom and your ex are at the hospital during and possibly a day or two after giving birth? And more worrisome, if your ex is trying to tweak your visitation agreement against your wishes now, will he get more aggressive with it later?

I agree with bluebox regarding truancy and pushing the visit back one week if he really wants that eighth week. Your ex needs to respect the need for his little girl to be in school. These are the years she's learning the absolute essentials of reading and math.

Hopefully your ex has to pay for the plane tickets. Try to get inflexible ones where the airline won't allow the flight dates to be changed and no refunds.

i live in canada and i know that there is no legal things the school can do if she misses too much school besides if she cant catch up she can be held back a year. i know that hes trying to manipulate the order i have am in contact with the local dept of justice medation department and as well to go talk to one of their lawyers to see what he has to say about what i can do. its just so frusterating we have a 47 page order that is so retartedly detailed and he still finds it necissary to pull stuff like this i have tried repeatedly to compromise with him over this and he just keeps telling me to F*** off.

Sounds familiar. My X did the same crap. Fortunately for me, he never followed through because I told him the court papers would be waiting for him when he got back. And they always were. I spent every penny I had and didn't have to get my girl away from that jerk! No regrets. Hopefully, he is just pulling your chain trying to get at you. What's in the court order is in the court order. All he has to do is break it once. Be sure you are loaded with physical proof. Good Luck
