A parenting plan does not come into play (in the courts) unless the court feels both parents are leaning towards irresponsible behaviors and it appears such behaviors will impact the best interests of the child or children. Otherwise, any parenting to be done is strictly the preference of the individual parent and not the business of the courts. Unless there is a compelling reason at hand, expecting a parenting plan is a government intrusion into ones private life for either parent.
The courts here expect custody to be 50/50, with sharing of expenses a matter of course. In my case, the judge made a point of saying he did not want to be given cause to be involved in such decisions, that he expected myself and my ex to work out such things between us. If he did get involved we would not like the outcome.
In effect, the courts here put the responsibility for parenting where it belongs--on the parents. As our judge said--you were parents of these children before the divorce, you are still the parents now. Its the attorneys that try to interject the percentages thing into the issue, usually based on the greed of their client.
Now, my own attorney pointed out that many people like to 'borrow' such ideas like this parenting plan thing from other states and try to interject it here in Va. Many lawyers take advantage of their clients lack of knowledge of the actual law and use it to pad their billing. Thats one of the background stories that make up most of the horror stories about divorce attorneys.
Btw, in Va, there is no such thing as legal separation either. You are married until the court says you are not married, regardless of whether you live apart or together. The term is used loosely, but has no legal weight.
