I have just recently heard from my X's Mom that he is talking about moving out of the Country with his girlfriend (whom he had an affair with by the way). Now, he hasn't said anything to me about it and I am not going to tell him that I know. I mean, it IS just a rumour right??

My concern: Why is it that everyone knows but me?

We have joint physical and legal custody. I am afraid that he is being silent because he has plans to take me to court for full custody. Would any judge in his right mind allow that?? I know I need to talk to a lawyer but I was just wondering what any of you would do if you heard this rumour?? I have a clean slate and I don't use drugs at all so I know he can't find me unfit. Do you think I should just sit on this one a nd wait to see if it pans out or what!!??

Hmmmm. That's a tough one. I would probably consult a lawyer to find out about the process. We have in our divorce that if either one of us moves a certain amount of miles from where we currently live the other parent automatically gets primary physical custody and we would head back to mediation to work out visitation for the other parent. Check the internet to see if you can find out about your rights. I don't think a judge would let him take your child out of the country. But, what do I know. Crazy stuff happens.

I would get a lawyer right now.. you need to protect yourself.. if your ex really is planning to move out of the country, he may not be telling you because he may be planning to take your child and you may never see him again. I am not trying to scare you, but I have heard many many times of men taking their kids out of the country, and there is nothing that anyone can do about it.

NO - a judge will not allow him to take the child out of the country to live. I doubt he would even make visitation easy for him on that note.
But if he leaves with the child without asking then that is kidnapping - I would be more concerned with that aspect. I would also call him on it in advance. But then I am like that.
