If you aren't receving all the child support then you are entitled to your ex's tax returns and depending how much he gets behind he could loose his license. Maybe try talking to him and get the situation resolved before it gets out of hand.

I don't really know about this, but when money moves it leaves a trail. Get the proof from your X's workplace that they have been sending in the payments and confront the FOC with that. I'm not sure this is a legal problem, sounds like more of a faulty process. If your X cannot provide the proof that he was garnished and the funds were sent in, I smell a rat.

well, taxes are another issue for another time...as far as his license...because I am seeing some money(there thought is something is better than nothing..me getting something shows he is giving it effort)....they aren't going to go after it. He is $20,000+ on what is owed to our son.
As far as proof goes, I have seen the pay stubs with the monies deducted. Our next step is going to be going to FOC together to show the pay stubs there, just to start our own paper trail. I did some reading on line on my state's CS website about income with holding...if they are taking it (which based on pay stubs-they are) and not sending it in, they can be held in contempt of court and are liable for the money according to the FOC site....once we show this to the FOC...then I think it'll be lawyer time because the FOC here stinks...thanks for your help!!!!

Seeing the pay stubs is a good start, get copies of every last one of them, then he should ask the payroll dept for proof they are sending in the funds. That would be a copy of a check or a wire transfer. The check may include other people so they may want to give a copy with no info on it and the amount would not be all him - then ask for a letter from the payroll dept saying that they sent X amount on his behalf on X dates. If they balk contact the HR dept or the legal dept and say that the company is in danger of being in violation. Of what, I"m not sure, but I"m sure it is something!

The problem is it is a small company...the payroll person is also the secretary..acccountant and whatever....they claim they have sent in payments...yet FOC has no record of them. Supposedly 3 payments were mailed in September, yet I got one and really that one got mailed after my EX went in and totally nutted up on them. they are full of crap and it's getting soooooooooooo old. Just like a payment was made on Tuesday @ the FOC office....again, there is no record of this at the FOC!

Again, if they have sent in payments, they should be able to provide you with a copy of the payment,such as a check or a wire transfer. If they can't, they did not send the payment.

I am recently divorced, and I just had my wages garnished starting last month. After reading this I just called my ex and she gets her child support checks just two days after I get mine. Further, the Friend of the Court has asked her to auto debit so she can get paid the same day I get paid. Something is definitely wrong here, either the guy is lying (which should be a question as no honorable man would owe $20,000 in child support if he had a job) or this is new and there are some error on the company's side. Friday evening my ex mailed in a payment on his own to the FOC to see if I get it. His employer has given him check stubs that were of checks supposedly sent....well the numbers of the checks go in consecutive order but the checks were dated weeks apart...so he and I are taking those and going down to the FOC.
My Ex really isn't a bad guy, just not always a smart one. He did fall on some pretty hard times, went from making big money to squat...spent months unemployed (paid CS til unemployment ran out) which seems to be pretty normal here in MI. Yeah 20,000 would make normal people question his honor...but truly sometimes bad stuff happens to decent people.

This happens to me sometimes. My sons biodad gets his wages garnished and there might be a month when I receive nothing then all of the sudden I get two payments in a row. My casworker told me to treat cs like a Christmas present each month, you may or may not get it so don't budget it into household expenses.

Charges can actually be brought against the company. I'm not sure the process but maybe you need an attorney (and ask for attorney charges as well when you take them to court). My sister used to work in accounts payable at a factory and they told her that if she didn't get the payment out within a timeframe, SHE could be charged. She couldn't remember the timeframe.

I've been having the same sort of trouble. It's almost the end of October and still haven't received x's CS from September. His company told me last week that it was taken care of...but still no money. I have direct deposit and as soon as the child support office receives the money, it goes into my account and is automatically deposited in my bank account IMMEDIATELY. If this is still happening by the end of the year, they'll be hearing from my attorney and I'll be asking for them to pay the bill!

My boyfried is being garnished $120 a week and we found out his employer took it out but did not pay. This was since July of this year as well. We hired a lawyer. We're still in process and we did go in front to the AG last week and the company can get in trouble for this...

I would NEVER count on child support in my budget. You never know when it will stop coming for any number of reasons.

Well that is at the moment easier said than done...
