My ex husband lost his job and has not paid child support in a while. I would like to know what the law states about trying to get child support and back child suport if the ex does not have a job. Does he get a free pass for all these months because he does not have a job. I understand times are tough but regardless if he pays or not I still have 4 children to support. I\'m trying to be very understanding about his situation but how long do I be understanding for? Any advice would be greatly appricatied.
I went to our state job service web site and downloaded the "average" wage for his field (when he worked) in all the surrounding counties (this is when he claimed he was now self employed and not making any money)......the judge "imputed" him a wage and told him if he couldn\'t make that at his business he should get a job
When he did and then got laid off and went back to court saying he shouldn\'t pay anything because he was out of work... I went online to the local newspapers and printed out want ads for jobs he was qualified for and used the wages listed as evidence of the amounts and jobs out there....he was also getting unemployment and they used that too.....
generally even if someone is unskilled they can use minimum wage as a base
