In Virginia, there is no such thing as a restraining order. There are Three types of Domestic Protective Orders and each serves their own purposes.
The first kind of Protective Order is an Emergency Protective Order. An E.P.O. is issued by a magistrate and it is good for 72 hours at a minimum. It can go longer if it needs to be in effect until the next Juvenile and Domestic Relations Court. It is obtained at a time when the court is usually not open and it is an emergency step to intervene in situations that need intervening.
The second kind is a Preliminary Protective Order. It is good for a length of time until a court hearing can be held with the suspect present in court and the victim is also present. The order is issued by the judge and it is done by a petition through the JDR court. The clerk can walk you through the process.
The Final kind is a Permanent Protective Order. This order is good for as long as it is needed. It is done by the court during a hearing. It is done after the P.P.O.
To get a Protective Order a victim must present testimony that the victim is in fear for their life or safety. Things that are admissible are past history, assaultive behavior, statements by the suspect, photographs of physical injuries, damage done inside the residence (it shows violence), past violent criminal history, and other things that would lead a reasonable prudent person to believe that the victim could be in fear for their safety.
Protective orders can be anywhere from "No Violent Contact" where contact is allowed but it is violated if the subject gets violent or makes violent statement to "No Contact" where the suspect is to have no contact with the victim. No Contact would include spoken work, email, cell phone, home phone, pager, or any other means of communication. Some Protective orders also state a range where the suspect can't be anywhere within X amout of distance from the victim.
Protective Orders can be obtained and they can be dismissed by a judge. If the need to get rid of a protective order exists, then you can go before the judge and request for it to be dismissed.
