Yes, the house is in BOTH our names. I am physically sick right now. I am only thinking of my two kids. He is thinking about his whore who is spending his money by the thousands.

if the house is in both of your names.. wouldnt both signatures be required on any kind of loan on it? Im really not sure how all of this works.. may be best to talk to a lawyer if you havent already...

I think both of your names have to be on any kind of paperwork reguarding the anything that is in both of oyur names unless he signs your name then you got him for sure can you sat feloney?

If the house is in both your names then I would have your lawyer contact the lender immediately and inquire as to how he is able to take out a HELOC without you....could be that he had the whore or someone else pose as you or forge your name...

Agreed that it would probably need both names. Watch to see if he gets the slut to forge your name. Call the financial institution that he applied from and find out if your name is anywhere on it.

I think he can legally take out an equity loan by himself, it would put be a lien against the house which is in both names. Not fair, but legal. If I were you, I would get the equity loan and put it away. It may put a lien against your house so he may not be able to do the same.

Take the money and pay off YOUR car in YOUR name or YOUR CC in YOUR name if you think he will not play fair. I have found out if you are nice, he will take advantage of it, give an inch and he'll take a mile.

One thing I did and do not regret is when my X took in a roommate and would not tell me anything about him, I would not allow my kids to go with him at all. He could have taken them legally, but I got his superior officer involved to stop him. In the military, they are strict on child support, alimony, anything of the sort. His officer agreed he needed to tell me who this guy is and his background etc. He dared not pick them up and would not tell me anything to prove his point, until he got rid of his roommate. As far as I knew, the guy could have been a killer, rapist thief etc. and my kids were not going to find out the wrong way.

Never thought I would have ended up divorced and when we bought our house, I was even willing to put it all in his name for the sake of not wanting to deal with closing paperwork, but so glad I did now.

From the beginning when he started cheating, I started paying MY CCs off that he racked up on. When the divorce was final, he was left with his CC that he racked up. He took the better car and his old car too. I was left with a good but old car my parents gave us. i think that evened out the score. Actually it was bc of him that I had CC debt so no, he still owed me but at least my credit was cleared when I began a new life.

I work in lending at a large bank. He will not be able to take out the loan on your home without your signature and permission if you are listed on the note. If I were you, I would contact the branch manager at the bank that the letter came from and inform them that you will not be signing any documentation and explain the situation. I meant to say make sure HE cannot forge your signature. You can call the credit bureau agencies and place a fraud alert on your credit report. If any applications are submitted in your name, they will need to contact you to verify that you are the one applying. Sounds like it may be a good idea regardless of what happens with the HELOC.

immediately contact your mortgage lender and let them know that you are going through divorce proceedings. Ask them about what he can and cannot do. Tell them your concerns and ask them how it can be prevented.

Someone forged your signature for sure. Stop it right away and do put the fraud alert on your credit reports. Any credit cards that are joint, lower the limits or cancel.
