I'm trying to find verification of this on the internet, but am not having much luck. But seriously, you might be in a lot of trouble. If you're married and one spouse doesn't file tax returns or underpays his taxes, I think the IRS might be able to come after the other spouse for the outstanding amount.
I'm not sure if you have a lawyer of not, but if you don't, you might want to look into whether your county has a pro bono legal services clinic at the family law center in the circuit courthouse. Montgomery County has one, and there are lawyers on staff there who will answer some questions for you, and if you qualify, even represent you for free.
Please look into this. If I'm right and you're on the hook for this, there may be ways to get out from under this, but it will require proactive action on your part.

Thank you all. I will contact my lawyer on this and see what she says. After all, she should know the law, right?
I filed all the past years taxes as "married filing separately"
according to my accountant and the IRS, I am not responsible for his taxes, unless I had signed and filed a tax return with him.
They even sent me a refund check! I may get more back as they work there way back through all the returns I sent.
Not going to happen.
