If you're married and one spouse doesn't file tax returns or underpays his taxes, I think the IRS might be able to come after the other spouse for the outstanding amount.

I'm not sure if you have a lawyer of not, but if you don't, you might want to look into whether your county has a pro bono legal services clinic at the family law center in the circuit courthouse. Montgomery County has one, and there are lawyers on staff there who will answer some questions for you, and if you qualify, even represent you for free.

Please look into this. If I'm right and you're on the hook for this, there may be ways to get out from under this, but it will require proactive action on your part.

No way is she in trouble. my ex lied his ass off to them. There's a very viable innocent spouse defense here. She is NOT in trouble.

hey dejimis mary is correct u should have an injured spouse case here. What i would do is go to the irs and file whatever forms u need to cover u ass. Just in case He may try to lie and drag u in . Get it done as soon as possible even if u get u lawyer to help. But i hvae dealt with the irs on a personal basis and if u are honest with them they will be good with u just do not play games and all should be fine. And mine was none payment of quarterly withholdings on time which is like your boss taking u money and holding it. They just talked and got it straightened out i did not avoid it. And i have also not filed state taxes for 5 years and other than penalties once filed it was done. So i would get intouch just to cover your butt.

Mine hasn't file for 2 years. Said we didn't owe anything and wouldn't get anything back either.....kind of like coming out even. Kinda hard to believe, but then again, he's been known to lie :)

Well, my stbx and I had not filed taxes since 2000. He hadn't paid in what he was supposed to. This is partially why I left him. I was foolish to go along with it in the first place. I did work the entire time we were married, so I had my own returns to file.
I filed all the past years taxes as "married filing separately"
according to my accountant and the IRS, I am not responsible for his taxes, unless I had signed and filed a tax return with him.
They even sent me a refund check! I may get more back as they work there way back through all the returns I sent.

The fun thing is now my stbx is trying to get his tax debt seen as marital debt and make me pay half of it.
Not going to happen.
