It depends on the situation. I believe that if he didn't file, usually the IRS will file for him and it won't be beneficial for him. He will be responsible for all taxes owed plus a wopping 22% intrest. It adds up really quick. I found out last mayt hat my stbx and I forgot to add some retirement money that added a bunch to our taxes in 2005. The notification I received was said I owed 3 times the original number due to penalties and interest. It wasn't pretty.
FYI the statue of limitations on back taxes is usually 10 years but it can be extended easily by the IRS.

They can only take a certain amount from him because the government is not in the practice of putting people in jail if they are employed; especially if they have kids. Even if they don't, if you are working they will make you pay (garnish) at least some back taxes. It will be misery. Heck just having to talk to the lawyer will be misery enough...

You should go see your CPA and Financial Advisor.

I had to go to the IRS because my lawyer wants a copy of the last return I filed. I had been a stay at home mom for the past 8 years. My stbx owns his own business.

When my stbx and I didn't pay taxes for 2 years, what the IRS did was add 12,000 in penalties for each year. We are currently doing a payment plan with them to get the taxes and penalties paid off.

Diemjs, if he did not file does this mean you also did not file? You say you were/are a SAHM and I guess maybe that means you technically don't have an income so don't have to file? I just filed 'married filing separately' yesterday for 2007. I figure by the time 2008 taxes are due, we will be divorced (and if not just shoot me, pls). He already took a 5-year hiatus from taxes once that I dragged his silly ass out of by forcing the issue and paying it off to the tune of, like $300 a month for years until that debt was paid off. I was not about to go through another episide this year so I filed separately and he can do whatever he likes about his taxes.

I did just file for bankruptcy, so whatever happens, I think I am covered. Im sure this is why my lawyer had me do this, too, to keep me covered.
