Document this - I mean, what can it be doing to your kids to be told not to call you back? This is beyond tolerable.

The RO is against you? It should clearly outline rules of contact, including contacting the children. Unfortunately, if you are calling a child's cell phone and receive no response, you have no recourse against the stbx.

My stbx insist that my daughter have her cell with her the whole time they are with me. i took her cell phone once because we were in the movie theater, my stbx had her lawyers write a document stating I can't do that.

I would keep calling from your cell. You can then give a copy of the bill to the judge. You will be able to show him that you are trying to maintain contact with your children. He will see the lengths you have gone to to make sure your children are OK.

Your ex just handed you a present. Don't let her know that. Keep the calls going. Call 2-5 times a day. Call her family. Call her neighbors. Don't let it become so bad that she is saying you're stalking her.

Put a call into your lawyer. Ask him/her the best way to handle this.

But only do that if your RO defines calling the child's cell phone as a rule of contact. Otherwise it's harassment.

Sweet, the RO states that the only communication with the stbx is only through email and only pertain to parenting time. We got my daughter the cell phone so I can talk to the kids whenever we want. But, for some reason, my stbx takes the cell away when the kids are with her.

Then you should be fine. Can't imagine you have much legal recourse, but just keep calling. Maybe set up a specific time to ring her every day? Might work.

Also send text messages that simply state "please call me back, I haven't heard from you since ______." Being able to show a Judge your detailed phone bill that shows all outgoing calls to your daughter's phone AND the text messages will set your ex up for nothing good with the Judge. Custody and parenting time is decided a lot on which parent will encourage a relationship with the other parent. By her not letting the kids talk to you she is shooting herself in the foot. I know it sucks right now not talking to your kids, but just sit back and know a Judge will punish her for what she is doing. Write a list of each time you call and the fact that you don't get a call back. Make sure to write down if you do get a call back too.

Your lawyer does need to send a letter to her lawyer outlining what is going on too. Multiple letters if needed. So those can be shown to the Judge too.

Thanks for the feedback. I finally heard from my kids this morning. talked to them for awhile. The reason why they didn't call me is because they have been so "busy". I don't like the fact that my stbx make my kids lie to me.

Somer, I don't understand why you can't have the same stipulation: that your daughter keep her cell phone on her at all times so you can contact her, same as your stbx.

Doesn't she see how horrible it is to put your daughter in the middle of the two of you, being the go between? That's horrible. Your stbx might think she's sticking it to you, but she's really sticking it to your daughter.

The way my stbx sees it, she needs to know where the kids are at all times, especially with me, my daughter must have the cell phone on her. Since the kids are with her, my daughter doesn't need the cell phone, so she takes it from her.

She wants to control everything.

Have you tried to get the same stipulation? Bc that really doesn't seem fair to me. You should have the same rights/access that she does.

I understand that the legal world doesn't really work in the same rights/etc, but I would try it.

Stick with it Somer. Be careful with the RO and it's stipulations. So glad you finally were able to speak to your children. Make it less stressful and assume they 'were busy', at the same time keeping track of how much you are told that. Just like she can enforce an RO, you can show that she is hindering contact.
