The legal system just plain old SUCKS!

And I don't know what to do.

My ex husband has had no contact with my son in many months..which is a good thing....

But....

I found out last night that he has been incarcerated again...

And this was something pretty bad...and yes..alcohol related.

I'm expected to allow my son to have visitation with him 800 miles away for the holidays.

I'm stuck.

If I don't let him go, it's alienation...if I do let him go, he is put at risk and in danger.

What can I do?!

The law guardian refuses to hear me. Im told I have to let him go.

This causes me so much pain. That boy is my LIFE.

Im sick over this latest news... Just sick. Any suggestions, I would be greatly appreciative.

You mentioned your ex's attorney, but you never mentioned if you have your own? It sounds like you need a good attorney that is on your side to give you advice. This whole situation does not sound like it is in bet interest of your son.

Have you talked to family services? I would be talking to anyone who listened until I got some answers that made sense...

When your son goes, does he have a cell phone or can you get him a disposable one while he is there so he can call or text you daily so that you can be aware of his safety and he can call 911 if he feels he isnt safe..

Make sure you document your concerns with the court, family services or with the police. how and why you do to feel he will be safe...

The courts really need to get a better handle on these types of things. Child endangerment is not taken seriously enough. There was a local case in the paper not long ago where the custodial parent (father) had serious concerns over the child visiting the biological mother and her new live-in boyfriend because of instability and drug issues. It didn't end well.

Explore all avenues to provide the best possible protection for your child (even if it means a social worker needs to be there for the supervised visits). Good luck {{{{{{{hugs}}}}}}}}

I wouldn't stop at the law guardian. I would get my own atty then raise hell wherever I needed.

I'm sorry, but even if the pics weren't sexual in nature...by what MEANS does a swinger site need pics of someone's kid?

And, THAT coupled with indecent exposure? Not to mention DUI's??

Namaste - this law guardian sounds like a joke. Her word is not law...please check into as many resources as possible.

Keep documenting and call your attorney, a new one if you have to. It may be a huge fight and cost lots but it's the only way you'll have peace of mind. The system is crazy and very flawed so keep fighting it. His new arrest must count for something!
