I filed for divorce in May 2008. For many reasons, the marriage was broken, the kids older, we both wanted the divorce. Except the ex would not agree to anything. Went to court a few times, went to mediation, she just never agreed. Even when she did agree, swearing in front of a judge, she then contested her agreement and dragged me back into court. I warned her from the start that if we litigate then the lawyers would get everything, and we'd have nothing. I offered her everything for her agreement. But nope.
Last February, after our last round in court, I ended up with $3K of atty fees on a credit card. All the money is gone, there's nothing left. Still she won't agree to the divorce for some unknown reason. Since I have no money left, the case has been inactive for about a year. Now the judge entered a motion to dismiss based on inactivity. I don't want to be married to her, and she does not want to be married to me. This case gets dismissed, well I won't have to pay alimony anymore, as that was a temporary court order. But I am still stuck, unable to move forward in my life. I am still not free as I so dearly wish to be.
Does anyone here have any experience in this matter? We both have free will, I can't force her to agree to the divorce. We're not living together, haven't in almost 3 years.
I'm not Catholic, I'm not exactly sure what purgatory is. Except I think I'm in it.

Trying, her point is that she doesn't trust the offers I've written, or anything. Even when we had a hearing, and she agreed and raised her hand and swore to the terms of that hearing, she came back at me and contested that. The judge was not happy having to deal with an issue already settled. And I was unhappy having to pay 2K to go back to court to settle a matter that had already been settled, just to hear the judge say there was no justification to rehear what had already been agreed to.
I'm thinking of talking to a new atty, just to find out my options. My current atty will charge me for every email and phone call, and I am tapped out.
EVen if you've remarried. Only thing I've gotten any real answer on myself.
GSCH - my atty told me that without an agreement signed by both parties, then a judge must order the divorce. Meaning hearings and court appearances. I have no way to pay for that - atty advised that including his fees I could be looking at another $10K - $15K to litigate this fully. Thats why I feel stuck. I don't want this divorce case to end, as I can see her running up debt and expecting me to pay. I want this over, I want to move on, i need to move on.

being legally tied like this can lead to all sorts of bad things. so, get that divorce as fast as possible.
