In my agreement w/X he was supposed to provide methe house we shared until my son graduates from High School 2011. I don't get spousal support for this reason, this was written very clearly in Court Orders. Well, my wonderful X called yesterday and told me he losing the house.
Gave the following options:
give him $7500.00 and $1000.00 a month
pay him $1500.00 a month
let it get foreclosed
My attorney says, not much we can do if he lets it go in foreclosure, X can afford this home just doesn't want to.
Whats the use of getting things in Court Orders if they can't/won't be upheld.
Sale date for home is set for June 24,2009
First impluse was to destroy X any way I could but after calming down realized that that a waste of energy. So now I have to find a place that will take animals ( LOL few and far).

It should have been mandated in your divorce decree that he makes the house payments. You should hang your attorney up by the short hairs!!!
I knew him pretty well and realized he wouldn't do that, but it was a consideration when we settled out of court.
So sorry about this. Is there any way he should have to help pay for your apartment or moving expenses?

The sad part is when he called to tell me that where he lives was in default also(my name is on that mortgage as well). I told him it sucks to be him and my credit could be restored and where I live and the other house were all taken care of and I hung up on him. He ended up taking care of his mortgage and I have never heard from him again. Our youngest daughter is living with him. she came over hysterical when this happened said she heard it from her friend that the house was in default and she was concerned as to where she was going to live(he lured her back to live with him...she is 20). He went out of state while he was in default....for fun. Can we say fucktard here????
I am sorry he is such an ass.
So why won't/can't they force the issue if there is proof he has the money.
I had ask that X pay me house pymt which I would then make house pymt. this would have assured that pymt was being made, judge decided that wasn't needed, as long as X agrred to fulfil the terms set.
I paid a Attorney to get all this in writing, when in the end it means SQUAT. I feel cheated and so disappointed in the CA system.
X is probadly going to move in house, had the gall to tell me he wants me to leave the furniture, YEAH right screw him, I going to sell everything that I don't take down to the hoses in the yard....
