OK here goes, the stbx and I have been dealing with our divorce for the past 3 yrs. We both attended mediation in March 2008. Only thing prolonging the D was payment of her attrney fees, btw she was the one who filed and hired this a$$. At mediation we agreed there would be no CS, property was divided, a bankruptcy was filed,(which I paid for), child remains with me, and I volunteeered to pay $1300 a year til her attny was paid the sum of $5240.
The stbx moved out of state, with her "friend", did not see her youngest son, 16, for over 6 mnths. Moved back to home state, got a job, gave up her quest for disability, changed jobs and still her attny insists I pay his fees.
Granted I make fair change for this area, yet I did not hire this man, nor have I received one oz. of help from her in regards to our sons needs.
Her attnys last request is that I pay $250 per month til the sum of $7000 is paid, if I am late more than 5 days the monthly amount goes to $450.
My ? would be this, when mediation took place I agreed to pay the $5240 as specified above, we both agreed to no CS. Now months later her attny has thrown the $5240 out the window, my payment plan also.
If that is applicable, then should not back CS in the amount of $7000 also be. My attny says judgement will be brought against me, but the amount was agreed on in March 2008 Should I have to pay his full fee, she is working, she incurs no cost at all concerning our child.
I want this over, but damn, I did not want the divorce, I did not hire her attny, yet it appears I will pay regardless.
Any one have similar scenarios or advice, where I work is going into the slow phase of the year, my paycheck will suffer dramatically. yet this has to end. WTF do I do?

Scary to find out they can screw us over with stupid mediation and atty fees. Are you like me and feel absolutely will never marry again?
If you went to court, then it would spelled it out in court. But it sounded like you guys used her attorney only. Where is your attorney?
Or you even have one.
If not, go talk to an attorney.
OK, what claim does he (her lawyer) have for you paying him? Is there a dollar value set forth in the divorce agreement? This sounds like contract law. And I know nothing about it.
But if it was me, and if I had the cash or access to the cash (low interest loan....), I'd play "Let's Make a Deal". And I'd offer him the $5240 in cash, in exchange for a paper saying you will never owe any more.
Beyond that, I think someone would have to see the documents to give you better advice.
Sounds like he is going after you because going after your Ex is like getting blood from a stone... I would only use Bankruptcy as your last defense.... IMO
Money is tight, I don't know how that attorney expect you to pay $250/mon. He also knew that you filed for bankruptcy.
I hope there is attorney here somewhere to give you good advice.
