Breakups & Divorce Support Group
Just broke up with someone or in the midst of a difficult divorce? Breaking up is difficult no matter what the circumstances are. They say that time heals all wounds, but sometimes a listening ear or a hug can work wonders for the heart. Whether you need a place to vent, someone to hold you to No Contact, or need advice about what to do, we're here to help.
A friend of mine has 80/20 custody of her son with the primary amount of time spent with her. Her ex's child support payments to her are high as her ex makes a lot of money. He didn't want to pay so he naturally decided to sue to equal custody. It has nothing to do with wanting to spend more time with his son. when his son is with him, he doesn't do much more than watch TV. He never asked for more time with his son until the support payments went up.
First, do you want the custody situation as it has been? Would you like to continue being the primary caregiver and do you believe in your heart that that's best for them? That's the most important question to answer.
Next, the lawyer will fill in the blanks that I cannot here, but the way that things have been going there for the last 1.5 yrs "should" be a strong case for your defending against her swooping in like this.
I'm in Colorado - and it does vary from state to state - but i had a similar situation. Kids spent 5 out of 7 nights at my place, then, as court time approached, she began expressing desire to take primary role. Told lawyer, lawyer smelled this from a mile away. What was important was that it could be shown that she "suddenly" wanted to be in her kids' lives... and it just happened to coincide with divorce court-time... where they begin to discuss $$$. The "how to establish this" in a way that courts recognize it is key here.
Talk to a lawyer.
Best of luck to you and those kids!
