So I just got a letter in the mail today stating that my child support will be modified down to 0 because my ex has nothing and can't pay it.
Normally I'd say tough shit asshole! But I really have no reason to argue when I get SSI for them(my kids) based on the fact that he doesn't pay it any how. Most of their bills are paid for by milton hershey school any way. That being said I have no grounds to ask him to pay.
Even if I check the disagree box I will be dragged down to dauphin county (One hour away) and I have no solid ground to refuse him. I really literally have no case.
Still part of me wants to be a bitch and check no because he should be made to pay like every other father. Or sit in jail I don't give a shit! But all the kids bills are paid for by the school, so what can I say about it?
This son of a bitch has 5 kids and doesn't pay for any of them. I was hoping he'd die from a drug overdose by now. And here I was thinking I didn't have any emotions for him left! What a surprise I still have hatred! Why because he deserves to rot in jail and he's going to come out smelling like a rose yet again.
It's called consequences and he never seems to have to pay them or face them.
So is checking I agree the right thing to do

I need a lawyer is what I need. But I'm broke right now. I only have 60 days to retain one.
I think doing anything with out legal counsel would be stupid.

Frankly, I'd either check "no" or I'd offer the trade of signing over rights. That's exactly what my husband and I are going to do next year when bio-mom's CS is increased to the full amount. We know she won't pay it because she can't manage her money worth a damn, and already doesn't always pay now with it at minimum wage.
He sat in jail three times for 10 months before he was finally released and he started paying. They didn't find him to start this jail stuff for years so by that time he owed 45,000. I made him pay back every penny. My children are grown now and it was so much easier during their teen years with the help of child support even if it was forced by the courts. My son in 24 and his dad is still paying 50 payments to the state for all of the interest he accrued when the state helped me.
My point, where I live, Alabama, the court set his payments at what he was capable of making and told him to get a job. No child should suffer over a parent that doesn't want to contribute. You should check and you should pursue any help you can get out of him. It is only right he help pay for the lives he created.
When my ex received disability later on for some medical issues, he still had to pay a part of his check to the children, even though they received checked off of his SSDI. Fair?? I'm not sure. But my children went without when younger so I took advantage of this and made sure they never went without again. I guess It is a personal choice, but I still say they should pay, regardless of any other benefits the kids get. Just my opinion. Hope you get it all worked out in a way that you can feel good about. I jsut did everything by the law and that kept me having to make too amny decision out of it.

Even when he was on unemployment, we still sent cs to his ex.
I know how you feel, my sister's father of her kids never paid CS! He has at least 8 kids, 2 with my sister. He never had a job that they could take his taxes. He owns liquor stores and makes good $, but he puts the stores in his sister's name.
My niece and nephew are in their 20s now and my sister never got a dime!
It makes you so bitter.
I hope things work out for you. (I sort of wanted to suggest get a life insurance on your ex and maybe he'd have an accident, but I swear I'm not really that mean)
