So even with my child support order, the judge is trying to give this OC more than my TWO Legitimate children combined. They only gaveme $835/mo and they want to give her $952 because she lied about paying $600 in daycare (I know for a fact the child doesn't go to daycare). They gave him NO credit for my youngest child even though she is on his lease and tax returns as being solely dependent upon him. They are leaving him with less than $1000.00/month to take care of him and an infant child...any ideas? We go to court to appeal in a few weeks.
Here in Illinois, they take the children in order they were born when determining CS. My youngest came after the OC was born so they actually deducted on paper my child support by $400.00 per month. They made it so he didn't even exist. The OW ended up getting that money figured into her child support. That meant that even though my husband was already paying that $400 to me, since the OC was born first, he as entitled to that money before my child was. My husband has to continue paying both court orders. The courts could care less that he's paying to much in support.
Our attorney told us that the courts don't care that my husband is living on $1200 per month and the OW is making more then him per month. As long as he keeps up with his court ordered payment it's not their problem.
That's why there needs to be an overhaul on the child support courts. As far as the appeal, I would get documentation of the daycare amounts. That could be your saving grace
