Our OW lied and was working but we couldn't prove it. The state didn't care. That's was a different state though. I know after like 3 or so many years he can ask for tghem to review the case. There should be something in there that modifies it for children as well. I have my husband on state lrdered child supportt. It helped us trmendously. Our second child together isn't but I might modify our order or just leave it the way it is. He can call the CPS office and ask, tell them his suspisions and about his other kids. I found out our OW was working simply by snooping her personal pages. Of course, our OW isn't very smart and had her social media profiles all over and all open. I took screen shots of everything and we turned it in. Now they are redetermining.

However, check on your state laws for the specifics on including your children together. We made the nasty discovery when OW first appeared that our state does not consider that the H has a family and only looks at his income as though he is a single man. In the words of one of the state workers I spoke to "Your kid could have cancer and the state won't care. The only way to go around it is to leave your husband and claim support for yourself." Some states, however, will take your family into consideration when determining payments, but because of that, they may also include your income in his calculations as well. :( That's the only plus to our state not including our children- they can't touch any income I make. H said once if he ever wins the lottery, he's handing me the ticket to turn in in my name.

can you snoop on her facebook or anything? I don't have facebook, but have a fake account with no information just so I can see what's on hers (I'm sure I can only see limited stuff, but it's something). I found out she has to move back home 4 hours away (which DH said she always said she would never do, so it must hurt her). What worries me now is that she probably will have to quit her job and will try to come after my DH for at least medical insurance (when we were in court in Dec she tried to fight for it, but they told her it would be too much plus support, she cried and said "but what if I lose my job in the next year" (how convienent) and they told her then she could come back and try to modify. See if you can find her on any social networks to snoop on where she works or what she's up to.

As far as your kids being included, that is different by state I believe. We got lucky and the lady who figured it out gave him credit for our son. She said they normally don't do that but she could see in the computer that he was up to date and always on time with payments for his daughter from a previous relationship and she knew we were married so I'm sure she understood the situation with OW.
