These things vary from state to state hurt. I personally live in FL and need to get bussy and claim cs for my 3 kids as well. Ow has not done it yet even though he pays oc after school care. When its over Im sure she will. Not sure how to tell you to go a out it but get on it. Here the dept of revenue or straight to courts handles it. Dont get left behind. We r divorced but back toguether and he agrees on me doing this too. Best of luck.

Hurt, there's got to be something built into the system to verify everyone's income since things can change or at least a method for verifying income. The people at the office of recovery services or whatever it's called in your state are probably not informed about how it all works, just their part. I would recommend to you what I recommended to Barefoot in a previous post and one today. Contact your state representative and senator. They should know how statute works in your state and what remedies are available to you. Good luck!.

It depends on the state. In our state it depends on the judge/mediator if they want to consider kids in the household. Thankfully ours did include our son because the situation was so obvious and I think she felt bad for me even tho I didn't talk at all during the whole thing.

OW tried to say she wanted medical too cause what happened if she lost her job in the next year...umm does that not apply to my H also in this economy? idiot. She had the nerve to say to the mediator "he has a family, so I'm sure he has the family plan and it'll cost nothing to add OC." No idiot he doesn't, I have my son on my insurance through work...and why would you admit that you have a child with a man that has a family and here you are fighting for scraps in court LOL. The mediator told her a judge will turn it down if it was too much plus support so she dropped it...for now at least.

good luck to you. I think it's so unfair how the courts factor support, especially in these situations. I honestly think that if 2 people have a child and they have never lived together, the non custodial parent should not be forced to pay support. And how children in the household/marriage don't count, but children outside only do. That makes no sense...so because the parents of the household have parents that are together/married they don't matter? it's so frustrating

Oh, I agree. I'm always saying that I bet a lot of this "baby momma drama madness" would slow down if they limited the percentage someone gets in child support if they are not married (unless they have an otherwise agreed upon arrangement.) H said it wouldn't work because there are people in partnerships who don't want to marry. I say fine, if they are in a partnership and have children together, they can argue the case (like a common law marriage of sorts.) It would certainly deter women from purposely going after men like this. Of course, it would also hurt others who didn't intend on getting pregnant... I don't know. Things I ponder. I've had some seriously overboard thought some nights, lol.

Can't help with the CS question. Find a good lawyer that specializes in in Family Law in your county as in Mississippi what is law and what is actually adhered to and enforced comes down to personal preferences of the Judges in each circuit. It can vary from county to counyt!
