My 73 year old FIL molested my 3 kids and 2 more of his grand kids.

In the past he has had some health problems. Stints put in for his heart on 2 separate occasions, years apart. And now his doctor is saying there is evidence in his brain showing he has had several strokes.

Some family members seem to think there is a condition that occurs after surgery in which a person's personality changes and this may be what caused him to abuse our kids. They have even looked it up on the internet as proof, though failed to show me such proof.

I call it bull. 2 questions. Anyone heard of such a claim? Can it be an argument in trial?

Old people do some pretty screwed up things after they have had strokes. I have several friends that have worked in nursing homes and they have told tales of old people pleasuring themselves with eating utensils and getting nurses to change their bed pans just to expose themselves, I am talking straight crazy shit that you would not think that an old person would do in a million years. So I would have to say yes, it is possible. The brain in a fragile computer. If he did actually have some strokes that screwed up his wiring, then there is no telling how his mind has changed. And yes, Mental Incompetency is a defense to prosecution. It is the insanity plea. Which is actually quite sad. This man may have been a good man and, through no fault of his own, suffered a short circuit in his brain. Now rather than being remembered as a loving father and husband, he will be remembered as a child molester. If this is truly the case.

So, yes, it's possible. Are you SURE he didn't have any pedophiliac tendencies prior to his illnesses? That's the key. Does it really represent a change in his brain function, or does his diminished capacity make it harder for him to hid his true nature?
