Parents Whose children have been sexually abused Community Group
This group is for parents whose children have been sexually abused. We welcome both Mothers and Fathers. Here, we can offer support to one another. We can vent, cry and lift each other up. No condemning or criticizing allowed. We are here for support. We LOVE (((HUGS))) !
My husband's Motion Hearing is scheduled for Nov. 6th. He is asking the judge for a "new trial," and a pre-trial release. His attorney will argue that her client did not get a "fair" trial ~ a Constitutional Right. She is citing "Juror Bias," which "can" be problematic for the prosecution.
Some of you have asked specific questions as to why a survivor of sexual abuse would automatically be considered "at risk" for bringing bias to the deliberations. The issue is, will an incest survivor (especially one who hasn't dealt with her anger toward her perpetrator) see jury duty in a CSA case, as a golden opportunity to assist in convicting a sex offender? If she/he never received "justice" in her/his own case, will she/he try to obtain justice vicariously through the prosecution of someone whose alleged to have committed sex crimes?
If so, the concern is that this juror will already have a prejudice going into the trial. She'll have an agenda. Her mind will be made up from the beginning, without weighing the evidence.
I am sure that instances like this happen, but it certainly doesn't represent the majority of survivors.
Another reason survivors may be excused, is for their own comfort level. Hearing graphic details about what happened to a child, during testimony, can trigger their own PTSD. This makes more sense to me. These are just 2 reasons why someone may be excused from jury duty in a case like ours. 22 potential jurors asked to be excused during the jury selection process. One reason, that it literally took an entire day to assemble a jury, when it typically takes only a few hours!
Please pray and/or send your highest intentions, that Judge Chavez will deny my husband a new trial; that the prosecution will succeed in convincing the Judge that it is NOT in the State's best interest to release my husband from prison even if he is granted a 2nd trial. Pray for my daughters. They are still reeling from the August trial and I don't want for them to be further traumatized by having to tell their story yet again!
