So, I found you guys again.  I have an update on our situation.  The victim advocate never got a response back from the DA (who was supposed to contact our detective and check back in) and I was told that a detective has the right to choose to close a case without ever submitting it to the DA, which seems to be what happened in our case.  She said very gently to go back in to the police and request that they amend our case with the new disclosures and share that "we FEEL that our investigation is not complete" emphasis on not being combative.  She said if our detective is still dismissive that we can go to his supervisor and explain our concerns.  She also said it won't hurt to call CPS.  

So this morning, I called CPS and gave them a list of updates (she said she didn't have the ability to listen to 15 pages of disclosures to catch up the last 4 months) including some of the most important information like my daughter witnessing my 4 year old being sexually/physically abused and raped, the monster trying to burn her with fire when she was cornered, the monster using rope to tie her down during rape, my 4 year old complaining about his booty hole hurting (she asked why I haven't taken him to the dr. and I explained he only last night let me look to see if there was a cut down there or something and I didn't want to traumatize him more as he had specifically stated he didn't want to go to the dr. but that it's in my future plans), the monster's mom "wacking" monster boy with a magtazine "all over" and the little sister telling my daughter "don't look, our house rule is were not alowed to see," the monster's mom not allowing my children to call me when something happened, a lot of my 4 year old's disclosures about being "slapped, punched, kicked, hit and crunched" and his privates being touched my monster's finger puppets, and my recall of bruises on my children and bandaids that I'd never realized were from my daughter that I'd see in the trashcan.  I also stated I did not have an agenda but simply wanted to help monster's family and protect others from being hurt like my children had.  She said she'd process all this and possibly open a new case on both our families.

This past week all 3 of my kids have seen their therapists, liked them and I feel it's a good fit (except we probably will still put my daughter with the EMDR specialist in August).  

I also contacted an attorney and he said he has no idea why the police have not pursued a case based upon everything I shared (including my son & daughters sexual abuse) but he also said that we don't really have a civil case either.  He said even if we won, unless they were able to prove legally that monster's family had done all these things, they couldn't enforce monetary compensation.  He said my best case scenario is to stick with the victim's advocate's advice.

So, that's my plan.  I'll be going into the police sooner than later with my husband to report the new stuff, including my emails and text messages to the perp's family during that time, and hope for the best.
