Emerald, what is CINA please? And where are you?

I had the same problem with the police not sure whether to even send the case to the cps because when my daughter was examined there was no physical evidence, however, although she was only 4 yrs old, she gave the police and social workers a lot of detail. The police were worried that she would be the youngest child they had ever taken to court, but, after a whole year of hell waiting to see what they were going to do, the police finally sent the case to the cps and they yes, enough evidence to go to court.

I would be very very surprised if the verbal evidence from not one, but two children, aged 10 and 12, would not be enough to get the case to court.

You need to get a lot of support for this, when, after 18 months we got to court, I was put through hell in the witness box, my daughter did a video link but it was still very traumatic. Thank god you have found this community and the women here can point you in the right direction.....in my experience the so called professionals such as social workers etc. are absolutely useless, you need to get in touch with specialist sexual abuse workers....talk to MOSAC they will give you advise and sign post you to 'real' professionals in your area.

CINA is a child in need of assistance and he's only going for it for my girls. But he is telling me to not get a divorce my kids have counseling set up to start going to. This is just all been hell and I'm lost as to what to do

I don't understand why this worker would advise not to get a divorce........you need more information......it might be that a divorce settlement at this point would give him rights of access to your kids.....maybe it's better to deal with the abuse case first, then go for the divorce....what do you think?

With the abuse case already founded he won't be able to see the kids. He's not aloud to see them now. I don't understand why he is telling me to stay with my husband or that me and my husband talk face to face. The worker wouldn't tell me anything that my girls said in the interview. And he hasn't really talked to me about anything since to let me know what was going on.

Request a different caseworker, or at least a consult with one.

This is why I'm so lost!! And no one can tell me if there is going to be criminal charges placed things they have told me that they want they still haven't came and girl it's still sitting in my house like they dont even care about any of this! It's all bs my life is still upside down and no one working this case seems to care about it. My daughter's have no signs of abuse at all and they keep asking for their dad to come home

Emerald this all sounds so confused.....I think you need an advocate, either professional, or just a very competent friend to help you understand what's going on.

I am a social worker and I worked with families going through similar situations although it was almost always drug cases. Here we call what you're describing CHINS cases. A lot of parents would use it as a face-saving thing, to try and prevent their kids being removed or to get less time. Do you feel your kids need to be involved with CINA? You will be getting agency referrals and involvement with social services contracted with your DCS office. If you've already found treatment providers in your own and you don't feel like you need other assistance, I wouldn't agree that you need it. That's my opinion. As far as what your worker is saying, I would find a lawyer now and schedule a consultation. I wouldn't do any face to face meetings or stop divorce proceedings until a lawyer tells you to. Lastly, go to your local DCS office and request all information they have in regards to your children. You are legally required access to this and they can redact private information of that isn't about your children. All you should have to do is sign a release. It usually takes about a week here to get the paperwork because they send it to their lawyer first. Hope this helps you in some way!

momofb2b.......it's so great you have professional knowledge and can advise emerald......I was a social worker in children's services over here in the UK, buts it's soooo different over your endz, and my knowledge is out of date.
