So apparently my soon to be ex husband's lawyer filed a motion of discovery today. I know this means his defense team will have access to statements but does anyone know if he will get to read mine and my daughter's statements? I definitely don't want him watching her video interviews. I wish I had a lawyer so I could know how this stuff works.

The women's services center near you should have a legal advocacy dept. The one I work for has one, and they are often able to get attorneys to help clients pro bono, but they are at least able to advise you in the law and the best course of action. Is the lawyer assigned to you a different one than the prosecuting atty? You can contact the prosecuting atty and ask questions, tho they are often busy and not able to get back to you very quickly, but he/she should be trying to rebut in writing or present in hearings anything that would help keep some info under wraps, though the other side does have a right to discovery. The assistant DA prosecuted our case and he returned my phone calls fairly quickly, even a few times a week, which I'm told is definitely not the norm. Hope this helps, good luck...

I had this happen too. The prosecutor asked me if the defense could view her taped interview and I said no. They did not give the defense the tape but they were allowed the written interview. Now, that said it wasn't my ex-husband, it was my stepson. Is it your child's biological or stepdad? I would think that would make a difference.

It's her step dad. The were not other adult males or older make children in our life at the time. I don't even know who the prosecutor is. I've only ever had contact with the detective. When I look up the case online it's still only the detectives name that comes up.

If I were you, I would try calling the court to find out if there is a victim's advocate who could speak to you. I made it very clear that I wanted to be kept in the loop and that I wanted my daughter's privacy to be protected.
