Can a mother take a child??
I don't know where to start. I'll leave this simple. Does anyone know if it is legal for a mother to take a child out of state and drop all contact between the father and child? A little back story, we weren't married when the child was born but married two years after. I did sign the birth certificate. She left one day with the child when the child was three and I have not heard a word from her since. I know alot of people will say it was because I was abusive or I did something so she had to leave but I was not and I never did anything to her. I took care of them both. I do know she was seeing someone, I used the word 'seeing' for lack of better word. It was an internet relationship, you know how that goes. She left everything here, including her laptop so I have a small bit of detail and a general idea. Apparently her need to be with this person was so great she had to go. She told me she was taking the child for a weekend with her mother and her sister's child who is the same age as our child. I spoke with her twice during her minivacation and she seemed normal and said she'd see me later the next evening. After I didn't hear from her the next night and she wasn't home when I got home from work I checked our phone records and to my surprise there was only one phone on our plan. She apparently had gotten a new phone, exactly the same as the one I knew her to have, and put it on her own plan. So I had no access to her phone information. I didn't know she'd done that. She paid all the bills (she was a stay at home mom and handled the finances) and I trusted her. Anyway, even more shockingly, she lied about alot of things she'd told me. She lied and omitted but those things are not important but what is important is that she was married at 20, and while she told me her marriage was annulled (short and produced no children and they didn't live together) she was still, technically very much married. It'd been ten years and, while I managed to track down the man she was married to, he was unhelpful and didn't really care. It was just paper to him. So moving on. It's been three years since she left with our child and I've run out of options. I've gone to the police and you already know what they said, they can't do anything without a court order and they'd have to know where she is. I've exhausted funds with attorney's who could do nothing but tell me that they can't do anything without knowing where she is. I don't know what to do. I've lost all hope. She only had her father and apparently, she's cut all contact with him. He even thought I'd done something to her but I have no and would not. She just left. I don't know. I haven't seen my child in three years. Birthdays, Christmases, first days of school.. I don't even know if my child is healthy, there is a medical issue in concern here. She left not a single trace. I don't even know her social security number. I can't even run a proper background check. There's alot at play here and I even tried getting a warrent sworn for her arrest for bigamy but, according to the law, the ORIGINAL spouse has the right to file charges for bigamy, that's the other man, not me, also, because she didn't receive anything (benefits, money, entitlements, healthcare etc) while being married to me, she hasn't defrauded anyone, and she only lied on the marriage app and that's only a $1,000 fine at most! The county or city or state won't even bother looking for her. This is still classified as a civil matter and until I know where she is I cannot even petition for anything in any court. Is this right? Four attorneys, the district attorney, the police, social services, other father's have told this just happens and I'm so numb and at the end of my rope I don't know what to do. Any advice at all?
