If the homework does not get done with the tutor, I remind at home 2 or 3 times, but no nagging and if it does not get done, I don't make a big deal about it. I have to sign my daughters homework assignment book and if it is not done, I write it in book and the teacher can deal with it. I have let it go and I have to say I feel so much more calm about it. it is 3rd grade - while I think homework is important, what she does or does not do in 3rd grade will not follow her to college.
I need to add that the school has not seen any of these behaviors I see at home. They were surprised that we were having her evalated. We are only half way through the testing process and it is so clear - don't know how my daughter is able to keep it together in school, but she can. Home is a whole different ball game.
Once again - thanks to the original poster - it is nice to have words of wisdom from someone who has been there.
