Depends on your state probably but I believe you would share the debt even if your separated, I don't know. Do you have a lawyer? Maybe you call one on a free consultation basis.

check it out with a lawyer. i think ANY DEBT he made with out you knowning well you two were together, even if he was cheating you two share.

If you legally separate then I believe the debts made after that will all be his.

I agree with the girls and have to say that in my state, all debts and obligations are both parties responsibility if made during a marriage. Sucks but it is true.

Those darned debt collectors do not care about a legal separation. They just want their money.

I have heard of situations where one spouse racks up debt on a credit card that is in their name only......thus was looked at as their personal debt and not marital debt. Sort of like a wife getting her own CC running it up before she divorces.....its looked at like her own.

Debt is accumulated DURING the marriage and doesn't go away if separated, unless he agrees to be solely responsible for it. Getting separated will only protect you from further debt accumulating.

My ex's MO was to get every credit card that ever came in the mail and to shift debt (unbeknownst to me). Every credit card was in his name SOLELY, I wasn't even aware of them, but I was responsible for half of the debt. That is what took my divorce so long. I refused to pay that debt, he wouldn't even show me a statement so that I could see where the money had gone. Three years into the separation he finally agreed to pay back (ha, ha) all the debt except for $10,000 that was given to me.

Who is he really trying to protect? It does depend on the state but you need to make sure he is not setting it up to put you in a bad position. My first wife, I later found out the hard way, had a few credit accounts that she had opened under my name, that I knew nothing about....until we separated and they went into default. Two of them I knew nothing about about until there were already judgements against me and they showed up on my credit report.

My name, her boyfriend's address in a city I'd never been to.

She later admitted that she did this on her lawyer's advice.
