Now to get my daughter to pay, all we have to do is find the money to hire a lawyer. Then through some magic find her and try to extract it from her non-working, drug addicted body.

Sara, My xDIL gets SS disability. Minor children of parents on SS disability get their own money separate from the parents payment. That money goes to whoever is appointed as payee, usually the parent but if the parent cannot handle the money or does not have custody some one else can apply to be the payee and handle the money for the child.

In my case I am guardian and I applied to be payee which was granted since I have courted ordered guardianship.

All the paper work shows me as payee, even the papers the SS printed off of the Direct Express page, even so Direct Express sent the debit card to the bio mom since she already had a debit card with them. How stupid !

It is everywhere. gd's mom lives in subsidized housing 2 br apt and pays 20% of market price. Also collecting child support for first daughter via Dept of Revenue FROM father of that daughter, and daughter lives with him as ordered by DCF! Also gets food stamps. And kids have been gone for 6 months. My idiot son set her up with a real nice Mercedes SUV, (they call it her 'truck', so cool). That's after totaling 3 cars in 3 years and burning up the engine in another. Two weeks after she got the Mercedes, had a 'bumper thumper' where she 'barely tapped' the driver in front of her getting onto the highway. Several thousand $ damage, so not truly a tap. Most likely texting, as she does not like to talk. She has left one or both girls in car alone while going in for cigs, gave 7 year old keys to car to listen to radio alone on a very busy street, oh my, I gotta stop this or I will just go on and on and this all has nothing to do with this discussion. It's just been annoying day, spent time with her and makes me nuts. Anyhow, we can mostly agree the system is pretty messed up. Too many agencies, and they dont really connect well.

All they have to do is freeze direct express acct. That is just like a credit card. If you can gain access on the account, follow instructions to report fraud.

Daisy, Yes it is that easy BUT they have to freeze it before she spends it. She gets the money again tomorrow and it will take them up to two weeks to process the claim to freeze her card. She is not the one that did fraud it is the Direct Express that gave her the money even though my name is listed as payee.

Grammy, even though they are wrong, your daughter could be held responsible for using money when she knew you were supposed to get it. as i mentioned, my sil kept checks for several months. Still shaking my head. SS called me and asked me if I still want a hold on my debit card. DUH I do not have a debit card, I do not have a lost debit card, I do not have a direct express account. Told her call back again when she gets the right information.

Don't hold your breath waiting for her to call. You need to pressure them and affirm your rights. Have you asked to speak to a supervisor? Sometimes helps. It sounds like paperwork has been duplicated. Believe me, I understand the frustrations but found I needed to follow through if I wanted things to happen. Good luck. Hope it will be rectified soon.
