2) The child has been removed from the parent pursuant to subarticle 3 or Section 63-7-1660, and has been out of the home for a period of six months following the adoption of a placement plan by court order or by agreement between the department and the parent, and the parent has not remedied the conditions which caused the removal.
The thing is , as always dss will use this when they want to and not when they don't want to. 6 months to complete a treatment plan may seem short, but to me it indicates wether or not the parents are willing to change . Currently dss in ac is under investigation for sending kids back home, who were shortly thereafter killed. I think think bill is a reaction to our legislatures seeing the consequences of these premature releases.
Someone mentioned babies going with their mothers to rehab , not in sc, that's insane. However, as in all cases, they SAY all grounds for tpr only count if it's in best interest of the child. Best interest is up for interpretation by the judge, but I'll bet harder to place , and older kids won't be severed in 6 months time,
The good news for grandparents in sc, I think it was last year, we have a new law that makes them add grandparents as a party to the case and stipulates if at all possible the children should be places with is. Another recent law , which about a dozen states share, spells out de facto custody,
This basically says if you've been caregiver (financial and physical)for baby 6 months or 3 year old and older for a year, you have equal standing as the parent to sue for custody in ac. It was under this statute I was given legal custody last year. The other states could benefit from this law, how many grands could be saved, that currently the grandparents have no rights but raise these kids under threats by parents, using the kids to control us, been there done that!
