As most of you know, once we accept the child under guardianship without a foster placement, not only can we NOT access financial assistance while we are guardians, we also cannot access post adoption subsidies and services once we adopt them. We had our 1st TPR hearing Wed. No one showed, but bio Dad was served so he was terminated. Mother-my daughter was notified, but under a signed petition for alternate service, so she could not be terminated until another hearing next month. I proposed to the court that I begin working on my license immediately, and at the next hearing, after daughter has been terminated I relinquish my guardianship , have him order the child to remain in my home, obtain the proper foster care paper work and then complete the adoption. He said he would support this, but to clesr it with CPS/DHS first. I called a worker,who is also a friend. and told him what I wanted to do. Although he has always been sympathetic to our situation, He also layed out the full range of possibilities.

1. because after the termination I will be the only parent to the child and by terminating my guardianship I will no longer be providing the necessary care a safety that the child requires and am in fact guilty of neglect & abuse under the abandonment statute. I would have to be reported, investigated, and even charged.

2. In the course of an investigation, a file would be opened, which would forever remain on record-no field trips with other children, no soccer coaching-you get the picture. It would also put my foster licensing in jeopardy.

3. during the time I am being investigated, H. could in fact be removed from the home.

4 Because the judge now has prior knowledge of this, if it goes to trial he may have to recuse himself and there would go my support.

Would this happen to this degree? He doubts it. But I have heard on this site, and many others that SS are capable of taking just such an action. Particularly because they did not do their job 4 years ago. they did not do their job last fall. so, to cover their butts, let's show Grandma once again who's boss.
My GS will be raised, in poverty, by Grandparents who cannot not afford to take care of themselves, who will most likelly have to sell their home (thats all thats left), in order to give him a chance at childhood,while if he were placed in a non-relative home, he would have the privileges allotted by the state of Michigan , at a far greater costs to his emotional well being. Oh, and I will probably be brought under scrutiny of doing this "Just for the money", or in an attempt to defraud the the government.
